Re: CCBC Claim form received from Arrow / Restons Re: Egg loan
The application was referred to a DJ on Friday for directions. Can take aprox 3-4 weeks to receive the outcome.
In the meantime, although Restons did send a copy of a purported Agreement, we've never requested one via the CCA route so sent a request to Arrow (the claimant in this action and who claim to be assigned the debt).
Received over the weekend what appears to be their standard reply to such requests:
Interesting that they don't accept to be the creditor under the Act but claim to have all the rights and benefits as sole claimant. Think it's a bit late to suspend all collection activity when a claim has already been issued.

"We thank you for your recent letter and acknowledge your request for documentation pursuant to the Consumer Credit Act 1974.
We do not accept that we are the creditor as envisaged by the above statute. However, we are willing to assist in obtaining that which has been requested. We will now process your request for documentation from the creditor and will revert in due course.
We confirm that all collection activity will be suspended pending provision of the documents.
We return the payment of £1.00."
