    Now why would Cohen want to respond within the court appointed time limits ??
    Don't be silly, if they have difficulty with even drafting a decent POC, something as advanced as reading a calendar will be beyond them

      thanks curlyben. do they normally then try to get the stay lifted? the court said they would have to explain why they did not adhere to the rules but would not give me details.

        Cohens try lots of thing, I believe they even attempted to find their nether regions with BOTH hands once, and failed

            Just received a letter telling me the case has been transferred to local court. Does this mean that CL did respond after all although I can't see anything from them? they hadn't the day after the deadline. What will happen now? I need to fill this in, but I thought the case would be stayed? thanks

              Anything after defence will be transferred to your local court to be dealt with, so no it doesnt mean anything has happened. If you arent sure then give the court a call and ask them.

                The courts have now told me that CL did respond on the 18th and the stay is lifted. I have to fill out the questionnaire by 5th October. Any ideas on my next moves? Is it getting time to just pay them? thanks

                  You MUST get a copy of CL response, after all with out it you are seriously disadvantaged.

                          Talked to the new court. they have the original and full file, but not the letter CL sent on the 18th requesting the lifting of the stay. It was "marked" as received into Northampton on the 18th, but that is all they can tell me. When I talked to Northampton, they said the text read that CL disagreed with me and that was all.

                          They have asked me to call in this time next week to see, although I told her I only have until the 5th to reply to their papers. She said to take her name and that she would make a note that I might be late in replying to them. Does this sound right to you?

                            Sounds about right.
                            So we need to do the AQ for this, I assume that's what you're referring to here.

                            To save me reading back, cos I'm having one of "those" days could you answer a few questions for me.

                            Have CL supplied you with Agreement, default notice and assignment documentation ?
                            Have they responded at all to your CPR request for information ?
                            You filed the holding defence on time etc ??

                            Any thing else you can think of I need to know ?

                              Hi CB.

                              I asked CL for the agreement etc as per your letter, and they sent me the agreement, which you checked and said looked ok, a statement of the account, and a covering letter. I have not had any default notices and the only assignment docs I had were a letter from CL, not Santander, telling me that it was now sold to them.

                              All defenses in on time, checked with the courts that they had received them on time, got posting receipts.

                                OK, so major failing on their part is zero assignment confirmation and also default notice compliance.
