    default on file can only have one name, the originators or if sold to lowells lowells name BUT the date of default stays the same.

    in case of 1 x defaulted account reported = 1 owner only, as stated lowells bought then their name date of default stays same

      Also sorry if I’m defending this claim and loose can I still then set up a payment plan with them and would I get a ccj. Also when I send the form off do I just ask for the default as on my claim form it says I failed to maintain contractual payments required by the agreement and a default notice was served.

        a) Morning just want to say I have got someone who is going to print the forms for me today.

        That's good news.

        b) So as the red and green bits will be removed can I hand write the address in and sign it hand written.

        You've amended the form to suit your circumstances removing the bits that don't apply, correct?

        Yes the address can be hand written, but don't sign the letters, just add your initial and surname.

        c) Also can you have 2 defaults on your credit report for the same debt.

        Yes you can, but in reality it shouldn't happen.

        d) As I had one on from shop direct and then one from Lowell. The shop direct one came off last year. Can they come off before six years.

        No it won't come off before 6 years unless the creditor removes it.

            they would just say that records show one sent out - judges accept that.

              loose and you can thru court set up repayment plane or if advise just before court case then you can ask consent form to agree payments and if you keep to it no CCA., but only do that if they have a 100% case which in most cases they do not have.

                Remember you request documents (evaluate what they send, then file your defence (based on what they send), then have the opportunity of mediation (to resolve the matter on the strength of your case). If it's not resolved the case moves on.

                The important thing is to stay calm and meet the deadlines. Ultimately be one step ahead.

                        I have today acknowledged online and also had printed out the cca and the cpr31.14 ready to post tomorrow. I have had to go over some of it in pen as printer was running out of ink. Will I have to attend court at any time through all of this. Just asking as never done any of these forms before.

                          Probably, but it might be a 'zoom hearing'.
