Sorry for the delay in replying, I suffer with depression and anxiety which is getting worse as my time to return to work gets imminent.

What do I say to them? Do I just ring and start talking about his health issues? I would have to do it because he couldn't. Or I can write a script for him to read. Usually with things involving him, I dial speak, they ask for him, he validates then says please speak to my wife and I deal with it. He doesn't even know about this Claim Form, I'm afraid of what he might do if he sees it.

Firstly, type up a letter of authority, it does not have to mention the court claim.
e.g. I, John Smith of XX address, give authority for my wife to speak with Cabot Financial on my behalf.
Sincerely John Smith.

You can add the account reference number for ease.
I will private message you a direct email to go straight through to the vulnerable client team. Once that is done, you can speak with Cabot on your husbands behalf without stressing him further.

I have started back work and that isn't going well due to high levels of anxieties and panic attacks. Everything is getting on top of me.


I am sorry for the delay in responding but I am dealing with a lot without much support. I really appreciate everyone taking the time to respond and apologies for untimely responding.

You should start drafting a defence using the Example Defence template, this will mean if they don’t come back to you before your deadline (21st) that you will be ready to file and only have to make a few changes then file if they do.

Ignore whatever the claimant suggests. Only contact them in writing for information you require. Should you need or require information from them at all that is.

You must go with & do whatever the court says only. Until you have anything in writing from the court saying different then it is business as usual.

Now it is time to write your defence .

I just submitted the defence but I think its a day or two late... don't know if that will create any problems. It's been a bad couple of weeks. Just been able to somewhat wrap my head round things.

I received another letter from Cabot requesting the statutory £1 payment, when I enclosed a £1 postal order for the CCA and anothee for the CPR. They say they cannot process request until received. So I have written to them enclosing receipts for postal order as well as the pictures which clearly shows they've been made out to Cabot.

They have acknowledged the CCA but not the CPR. Does that matter? Both were sent recorded delivery at the same time, in separate envelopes.

Can I also ask what is the difference between the 2?

I've also emailed Mortimer as suggested.

I'm absolutely shattered from those tasks so if I do not reply in a timely manner please bear with me.

Well done on all those actions! They must have felt like climbing a mountain.

CPR request is a request for any document mentioned in the claim particulars - it is an important part of the litigation process.
CCA request is a request to a creditor to see a copy of the original agreement, this is a statutory request and must be complied with or the account becomes unenforceable.
