  • Charging orders?

    Can somebody establish a charging order on a property that you do not own to recover your debt? Surely it would have to be in your name and attached to an agreement in your name as the owner?

    That is generally correct. What exactly is going on here?

      a debt attributed to me is being pursued at my wifes property which she owns outright. She has the land registry title and deeds in her name etc. I am not a full resident at her property.

        Has your judgement creditor applied for a charging order?

        If yes, your wife can oppose the application to make a final order (see earlier), or apply to discharge an order that has been made.

        Next time, start with the facts please. We'd have got to this point quicker.
