  • CCJ set aside hearing date looming

    Hi all,

    I've followed the advice of this forum via advice and its numerous guides and my CCJ set aside hearing is now looming.

    I have initially filed a witness statement with the court, along with the relevant forms etc in line with the advice of this forum to file ASAP. Since doing so, my research and investigation has continued.

    I have now received new information and evidence that will further support my claim. Do I submit this to the court at this stage? If so how? Or am I to leave any further submissions until my time in front of the judge.

    Submit it in advance and copies to the other party with an explanation that it has come to light since submitting the application. Write a Supplementary Witness Statement detailing what has happened since filing the application and exhibiting the documents.

        Hi,

        Just back from court and I'm delighted that the judgement was set aside. A major relief, as although I didn't owe the money I was very anxious to ensure this black mark didn't stay against me for any longer than absolutely necessary.

        Thanks to all concerned for the advice on this forum.

            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
