County Court Claim Form. Asset Link Capital. advice please

  • County Court Claim Form. Asset Link Capital. advice please

    Hi, I was after some advice please.

    I've received a claim form, the Particulars of Claim are:

    The claimant claims the whole of the outstanding balance.

    Opened effective from 16/11/2008.

    The defendant failed to make payment as required and by 29/06/2011 a default was recorded.

    As at 30/09/2016 the defendant owed Barclaycard plc the sum of 255153.

    By an agreement in writing the benefit of the dept has been legally assigned to the claimant effective 30/09/2016.




    From the info provided could someone tell me if this alleged dept is statute barred please?

    ​​​​​​​I did write to the claimants solicitor on the 11/08/2018 after they wrote to me threatening me with a county court claim, stating that I have never had a contract with Kearns solicitors or Asset Link Capital (No5).

    Depends on when you last made a payment to the debt (including to debt collectors)?

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
