    Hi, this is the first time I have received a CCJ notice of Claim for an old catalogue debt and would really appreciate some advice;

    1. Regarding the Acknowledgement of service form can this be used if you are unsure whether to accept or deny the claim... to be granted an extra 14 days to work out what to do?

    2. The amount being claimed shockingly seems a lot higher than the original debt; could this be due to many years worth of interest being added on? Unfortunately I do not have any paperwork for the original debt. But I thought it was at the most around 4.5k? Claimant is claiming double that figure??

    3. At the moment the only defence I have would be that an agreement was never signed? If the claimant has included the date the agreement was taken out on 2007 on the claim form would this indicate they have a copy of some sort of agreement?

    4. If I was to loose at court could the judge order me to pay in full? Which i couldn't afford to do?

    Can anyone help please? I am really stressed and worried as I am running out of time, the acknowledgement of service needs to be completed tomorrow for Thursday’s deadline?

      Acknowledge service ticking defend in full and putting nothing else on it.

      Post the information in the claim form using this template:

      Received a claim? Yes/No:
      Issue Date:
      Have you Acknowledged the Claim?:
      Total Amount Claimed:
      Claimant’s Name:
      Solicitors Firm:
      Original Creditor:
      Original Debt (eg. Credit card/Loan/Overdraft) :
      Particulars of Claim: Please type out in full excluding names/account numbers:
      Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?):
      List any letters you have sent (eg: CCA/ CPR )
      Any Other Information or Background Details:

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
