  • CCJ - Not sure what course of action I should take.

    I have recently checked my credit file as I am hoping to apply for a mortgage in a years time. Upon checking I see that I have a CCJ for £3177. I had absolutely no idea what the CCJ was for or who it was from. I called CCBC who told me it was from Thomas Higgins on behalf of a company that provided a storage service to me for a period of time. They claim I owe them 2860.90 for services between January 2013 and June 2014 and interest daily.

    Firstly I did not live at the address the CCJ forms were served too and secondly I did not use their services through all the dates claimed.

    I am in a bit of a muddle as I don't know if I should request the CCJ to be set aside or if I should write to the company and give a full and final settlement and for them to send me a invoice showing nill value so the CCJ can be satisifed.

    What is the date on the CCJ if more than a month old it may be recorded and paying will not remove it. Why pay a debt that is not yours?

      Exactly, a satisfied CCJ is still a CCJ and could adversely effect your ability to obtain a mortgage or if you can mean a higher interest rate. If you don't owe them anything then why should you be affected?

      I believe you should apply to set the judgement aside and therefore write to the claimant asking their consent giving them 7 days to reply.

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
