  • Submitting Evidence for a Third Party Debt Order

    Hi Everyone,

    Hoping someone can provide some guidance in this.

    Last year I obtained a CCJ as a Creditor. This CCJ was a Joint Judgement against 2 individuals.

    Unfortunately though I have tried some enforcement methods I have not been successful in getting the debtor/s to repay the money owed. I recently requested a TPDO to hopefully regain some of my money. I was then sent a court document detailing an interim order that had been issued and a court date set.

    Do I need to submit evidence in some way before the set court date as the creditor?
    When requesting the TPDO the total amount I requested includes all the enforcement costs associated with the Case Number (i.e Enforcement actions against both individuals) - am I allowed to claim this as it was a joint judgement?

    Do you know for sure that they have money in their bank account or financial assets enough to cover the judgement?

    The reason I ask is that if you have tried a Warrant of Control and/or Attachment of Earnings Order you might be throwing good money after bad.
