    What is going on with these Default Judgments ??

    It isn't hard, fill in a form or log in on MCOL and enter either an admission and offer to pay, or acknowledge and then enter a defence ( or an admission) after finding out more information.

    The forms are clear what to do. ( https://assets.publishing.service.go...21/n1c-eng.pdf ) Are they ? Are people contacting the claimant to sort it out and the claimant is still filing for default judgment? I don't believe that's the case, nor do I believe these are all going to wrong addresses or not being sent out by the court. So are people simply ignoring claims ? Why ? Fear or lack of information available ?

    people didn't respond when a court claim arrived ??

    That's incomprehensible to me

      I see too many people being told to ignore court claims atm ... more could be done to explain the process (and to make people realise that MCOL and Northampton bulk centre are REAL courts) and to make them aware of how to work through the process properly!
      Debt is like any other trap, easy enough to get into, but hard enough to get out of.

      It doesn't matter where your journey begins, so long as you begin it...

          I think you have hit the nail in the head in post #2 - Fear!

          When ever I talk to anyone about court they ask me am I not scared in the big room with all the people wearing wigs and having to remember to stand up etc.

          Once I explain that county court isn't like that and you're basically mostly in an office environment having a meeting then people are surprised.

          I think one of the problems with our justice system is that no cameras are allowed, my personal view is that the transmissions of cases should be allowed after they have been concluded with rules about obscuring identities and information in sensitive matters. It would take away some of the mystique and make justice more accessible.

          I think the advice of ignoring tends to be an urban myth surrounding parking, my friend registered here after I advised him not to ignore some parking tickets at Standted Airport, but the amount of people telling him to ignore me and just ignore the tickets because nobody even gets taken to court was ludicrous.

          Even once I had demonstrated that they do the same voice just harped on about ignoring the claim because there's nothing they can do anyway.

          Thankfully as my friend is a professional drive he chose to cover his bases and Ostel helped him out.

            Also, it's actually pretty rare to end up attending a hearing... ( unlike in Scotland ) … our system is mostly paperwork.
            The Supreme Court is televised regularly and there aren't any gowns/wigs or that malarkey.
            I am a bit guilty of telling people it's like going to the Dentist though, lots of tedious waiting on uncomfortable chairs, then in and out within a few minutes wondering what all the fuss was about lol.
            A CCJ on my credit file would scare me more though now - but that's cause my file is finally clearing up.

              Yeah the document says of 71,800 defended claims only 15,300 went to trial and that's just over 20% to trial. It's crazy as essentially you have a near 80% chance if you defend that you'll never end up in the court and will actually win.

              I suppose it depends on the state of your credit file, mine is actually that bad that I don't think a CCJ would really make a difference to me. Enforcement of one on the other hand would.

              You would think programs like Can't pay would scare people into dealing with things, but it's that attitude of it'll never happen to me... until it does!

              With 416,970 default judgements it's easy to see why the debt purchasers issue the claims they do.

              If 12% of the claims you issue are defended and then you discontinue and you only have to actually go to trail on 3% of your issued claims then there's lots to be gained in the other 85% once you start to enforce them.

                quite a lot of parking cases go undefended (not on here tho' ... we usually just see the aftermath ) but there are loads of money/debt/credit card claims that go undefended every day (I see what looks like hundreds a month on groups I have dealings with on FB) due to them being told that it's a 'fake court' or they can't do anything. The 'three letters' are just the tip of the iceberg unfortunately

                    Terrible - the effects of a ccj can be awful for some people. I guess the 7% reduction of enforcement apps in the stats is good news then lol.
