    CLAIM DISCONTINUED!!*jaguarsuk* - thank you for your ongoing advice, as well as others who have contributed too.

    After posting the letter to Lowell I almost instantly received their notice of discontinuance. So am I right in thinking this is totally over? Can I burn all but the most recent letter from them now?!

      Excellent, once they realised you knew what you are talking about they knew they were on to a loser.

      It should be over, but in the future if they somehow found a copy of the agreement they could apply to reopen the claim, but they would have to make a damn good case.

      The other option is they could sell it to another debt purchaser who might not necessarily be told a claim against you has been made and discontinued.

      Don't burn anything, wait for the court sealed version of the NoD to be sent to you and then scan everything to store on OneDrive and iCloud for if they are required in future.

        Hi there

        Following on from this, I have not yet received a court sealed version of the NoD, just the version from Lowell. I assume I should have had this by now despite recent circumstances?

          Not necessarily, a lot of civil court staff were furloughed and the concentration was on keeping criminal courts going.

          Hopefully you have had it by now and if not check with the court.

          Acknowledge Claim - within 14 days from Service

          Defend Claim - within 28 days from Service (IF you acknowledged in time)

          If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
