  • Reston's & second charge

    I have just received a letter off Reston's. They took me to court in 2013 and as I didn't know about this site then, they won. I thought the other day I must have paid that by now. After working it out I had overpaid by one payment £20. I emailed them and asked for that back and also to get the second charge lifter off my property.
    They have responded saying, thanks for the £20 we've passed it over to our client. You have paid in full. If you want the second charge removed it's going to cost you £100.35.
    Is this right I now have to pay to get a charge lifted that they had put on?

    Hmmm, discharging a registered charge is free with the landregistry. They may want to apply to the court for a certificate of satisfaction I suppose to send to the Land Registry, although as the judgment/charge holder they shouldn't need that. I've not heard of them charging to remove a charge before. Have they put that in writing ? ( the 35p sounds odd too )

      Are you sure you haven't got your calculations wrong by 1 month regarding the £20?

      If not they have no right to pass it to their client as it is more than the amount due. They have been Unjustly Enriched and they should pay it back to you.

            The first image is not good. the second image is ok to enlarge.

            Should I get in touch and ask them why they are trying to charge me? Obviously I need this removing from the Land Registry.

              I would direct them to the "Applications exempt from fee" on this site: https://www.gov.uk/guidance/hm-land-...th-a-fixed-fee

              The following applications are exempt from fee:
              • Discharge a registered charge.
              I suspect however this is not a fee they have to pay, but instead the fee they charge for their work (filling in the forms) to do it.

                Yep they don't explain a lot do they, I would ask them if they break down the cost as you have not previously been made aware of this charge and it isn't included in the Judgment.

                Acknowledge Claim - within 14 days from Service

                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
