    Non of my business but if you have not had a response from Di , I would email (not PM) her again and maybe post up you have emailed her. If you have its up to you if you say anything on here

      I am in discussion with Diane, and will be sending her the documentation I received but as it's the weekend I was going to leave it til Monday. Just wanted some light feedback that's all

          That depends if they provide anything meanwhile or if you really want it to go away- I am just saying, do not dismiss mediation out of hand, I would say that to anyone

              This is a letter from Lowells wanting to hurry things along, have you had an order from the court with a DQ?

              Personally I would wait for the court copy to complete and return by the date the court states as you are awaiting an SAR back from Halifax and don't want to unnecessarily move something along, then perhaps to agree something at Mediation only to realise after getting the SAR that you didn't need to agree to anything.

              Everybody is different, I like to dictate the pace of the game as opposed to play at my opponents pace.

                Have you ever been in a debt management plan at all - or possibly engaged a claims management company to reclaim ppi / unfair charges etc ? ( just thinking where this £1 might have come from ) - you could send a 'part 18' request for information letter asking for date, source etc of the alleged £1 payment. They have to evidence it is not statute barred you are correct, but seemingly doesn't stop them just saying a random £1 payment means it's not, hoping you wouldn't challenge it - but daft with an overdraft really as they could be arguing default date instead.

                  Even if the account had defaulted there may still have been a payment after that which would impact on any Statute Barred argument.

                  Acknowledge Claim - within 14 days from Service

                  Defend Claim - within 28 days from Service (IF you acknowledged in time)

                  If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
