  • Help with court case would be much appreciated

    Good evening all,

    I was hoping someone with far greater knowledge than myself could offer help and advice on a money claim online case. The claim was started following a badly installed block paved drive at our property.

    The defendant filed an acknowledgement of service in which he ticked he intended to contest the courts jurisdiction. I then received a letter from the courts a week later with a copy of a double sided defence letter he had sent in.

    This is where I am confused:

    - Can he tick contest jurisdiction then send in a defence?

    - Should he have completed a N9B defence and counterclaim form?

    - He has not addressed any of the particulars of claim points in his defence. He has also never responded to the emails and letters sent prior to court action. I don't think mediation will be of any benefit in view of this, but will it be seen in a negative light by the courts if I do not choose mediation?

    I think it would be useful for you to post the Particulars of Claim,the Defendants Defence and copy of Acknowledgement of service (with personal details removed).

      Don't worry about the contest jurisdiction part too much, people often tick that without actually knowing what it means. Are there any issues you are aware of, is the defendant based in Scotland and you've brought the claim in England or anything like that?

      He is fine to send a Defence to the court not on the N9B form.

      As Jaguarsuk said, it would be helpful to see the claim and the defence. You do have opportunity to respond to the defence if needed when you send in your Directions Questionnaire.
