Received letter from DWF??

Hi all,

you may remember my post about an issue with Tesco Shop and Scan where my mother and I forgot to scan a few items and were detained by Tesco and only told to expect a letter. That letter arrived on Thursday. I explained to my mum the advice from you guys here but she is still really worried :/ I have uploaded the letter and any further advice would be greatly appreciated.

DWF are in the same boat as RLP, despite being official 'solicitors', they have no more right to claim 'security costs' from you as anyone else.

I hadn't realised actually that Tesco had switched to DWF.

Hi Amethyst,

I wondered whom the were as I haven't read anything about them on here or anyone else! So the advice still stands, ignore them? £125 for security costs is appalling! How many letters (on average) are likely to arrive?

I haven't actually wrote to them to be honest with you. My mum just wants to leave it how is a never use Tesco again!

Yes ignore them as far as I am concerned, I don't know much about DWF though so they may have a different method to RLP. See if [MENTION=39710]des8[/MENTION] or anyone else has thoughts on dealing with DWF.

I've got to agree with Ame here [MENTION=91626]K_Z[/MENTION] ... DWF are no better than RLP and have NO standing in this issue whatsoever! They cannot force you to pay anything (there is NO debt) and furthermore they cannot take you/your mother to court themselves, that would be up to Tesco ... who won't be bothered about it now

I agree with the above, and would advise continuing to ignore.
DWF, although a law firm (as are Drydensfairfax ... another of my pet hates) act in the same way as RLP, except they may use the 'phone as well.
Their letter, coming from a solicitor, is running close to making a threatening demand as they do not specify what further action (?sending the heavies in).
Also it comes nowhere near complying with CPR (which although not an LBA one would expect better)

If they do phone refuse to speak to them and demand all communication is in writing.
If in a real bad mood tell them to go forth and multiply!!!!

If they do call I will be very surprised and upset as we did not give our telephone numbers during the initial incident!

I'll let you know if more letters arrive and if indeed they do manage to get a telephone number!

2nd (well they say 3rd didn't get it!) letter from DWF

Hey all, I'm back again.

Letter came today from DWF and my mother is freaking out! They are threatening with bailiff and court action. Court I gathered would be threatened from other threads but surely they have limited to no rights to send a bailiff to "collect the amount"?

P.s do you think "Sirs" is aimed at both my mother and I since we were together? If so, that's not very clear, only my mothers name is on the letter AND like I said we're both female...

Usual speculative nonsense.
They can't use bailiffs unless they win at court.
& imho they won't go to court.

As Charity said, keep ignoring.
If they actually had any hope of winning a court case, do you think they would continue writing saying they are CONSIDERING initiating court process?
If they had any serious intentions that way, the chances are you would have received a Letter before Action by now.

Hi sorry to jumping in on yours. Cant get myself to write my exact situation down... So upset... Banned for life... But what they told me the fine can vary from 80-couple of hundreds. Also if i don't pay a warrant can be issued and i can get taken by the police which was not involved.
