    Look forward to the pictures.
    You need to make sure you can show you are being reasonable by not letting him back in.
    As this will be a small claims court affair he will not be able to claim back his costs if he is successful.
    This means he would not use a solicitor as that would cost him in the region of £1500.
    However if your behaviour is deemed unreasonable by the court, he may be able to reclaim his costs.
    Normally it is expected that a tradesman would be given the chance to make good, but if you can show you have good reason to have lost faith it would not be unreasonable to refuse him that opportunity.
    It will be nice to see the pictures, but you will need more than our good wishes!
    Can you get that other fitter to give you a written quote, detailing all that is wrong? To be successful in court you will have to prove your losses, a guesstimate is insufficient.
    This won't take the place of an expert's report, but it will bolster your position.

    Another form of dispute resolution will be the court's (free) mediation service, which you will be invited to use when you file the claim.
    Or you could suggest a different mediation service (which would cost)

            This one does it for me How can they say there's no proof the fitter did a bad job when there's a gap like this??

                  i might reply to his solicitor as he has taken on his case ,and say i can supply the photographic evidence to him at the cost of duplicate pictures ,or am i supposed to reply to his solicitor or the fitter ?

                    if you've been contacted by his solicitor, then keep everything in writing (and through them). If it was my kitchen, I'd be advising the solicitors that I have photographic evidence (although I'm not sure you would be able to get away with charging for copies??).

                    Get a written quote from at least one other company to give weight to your asking the amount you're wanting to claim from the guy too!

                            A quote from someone else to rectify the work together with the photos should be sent to the fitter and his solicitor but as Des says you must offer him the chance to rectify the problem unlikely he will

                              he wants to come back ,but each time he came back he made thing's worse ,ie, realign the sink ,broken unit and ripped off clamps .................the thing is ,if we allow him back he will not be able to rectify all of the problems without taking out most of the kitchen and replacing it ,so we will end up disagreeing of what needs to be done and it will end in an argument that we do not want ...we will probably have to live with some of the faults as we do not want it taking out again ,our hearts would not stand it ...

                                Yeuk..... was this his first kitchen ever?

                                As Kati said, communicate only with his solicitor now.(it will cost him, but it was his choice)
                                Obtain at least 2 if not 3 detailed quotes to correct the work.
                                Write to solicitor explaining, in clinical fashion, what the fitter has done wrong, why you are not prepared to allow him to return and that you disagree that you are being unreasonable and would defend any claim they would try to bring under CPR27.14.(2) (g)

                                Also ask them where they believe your previous correspondence is not consistent with CPR rules Preaction Protocols.
                                Not having seen your previous correspondence one can't comment, but it wouldn't be fatal to your case anyway, especially as you are LiP.

                                I suspect you will deal with the solicitor through the early stages, he may even write the defence, but eventually the solicitor will withdraw as it makes no sense to rack up the costs when the chances of recovery are very slim. I've just been through a similar situation with a friend where the other side employed a firm of top solicitors to up the pressure on a £10000 claim, but eventually withdrew.
