    Thank you - I will as soon as I sort out scanner issue.

    So what you are saying is the fact he lied to me, knowing if he told the truth I wouldn't have signed the contract, makes no difference? I would never have signed into a contract that binds me to dual fees and I made that clear to the agent.

    So can they refuse to introduce somebody and then when they visit themselves claim a fee, assuming potential buyer not frightened off ? which he does seem to be.

      If you had recorded that, you could have used it, but, these jobs normally have an amount of commission for wages, and like some other salesmen, will push the boundaries a bit to achieve bonuses.

      The second part you mention, them introducing them..... there argument, quite correctly would probably be, it was a lead generated through there infrastructure, and that costs, setting up web pages, phone time, staff, ect,ect. .

      otherwise, all a seller would have to do, when a buyer found, would bin the estate agent off, and do the deal themselves. I do think you have room for negotiating,
      crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

        My arguement is that they never told me about the potential buyer - nothing until now. The potential buyer tried to make an arrangement to see me via them a few times and they refused and in the end words were said. He then came and paid me a visit. Surely if they refused to introduce us, the property was on hold with them, and they didn't tell me about it (if they had I would have taken it off hold) then I owe them no fees?

          For the initital nit I'm in sales and would never say a direct lie or give information which is in anyway stretched, however much I could do with the bonus!

            Hats off to you, but sadly some sales reps are given no option, as it's not always just bonus but their actual wage and keeping a job that drives them to lie.

              I've been forced to leave a job before now for refusing to lie and have ended up in a sorry financial state because of it and would do so again. These aren't little white lies they are porkers that could make peoples lives a misery and I wont be party to it. I'm more than well aware that in sales you are only as good as you were the week before and the stress of targets etc. There is no excuse for it.

                I have had a look at my contract and I would be liable for fees if I had instructed another agent before I signed this agreement.

                  Well looking at the contract I would be liable to dual fees if I signed for sole agency but I didn't I signed for multiple agency. I was already signed up with another agency and he knew I was staying with them and I stated clearly I wanted multiple and was paying the higher fee for multiple agency.

                  I lost my buyer in part because of this but he has said he will stand up for me if needed which is good of him.

                  I followed a link from the NAEA (as kindly given above) and called the Property Ombudsman who very kindly gave me some advice. I have to write to the agent again and if not satisfied then the complaints lady. If still not happy then back to the TPO who will then take it on for me. It would seem that I have at least half a leg to stand on... and more than likely both legs. The whole process could take a very long time but at least I know where I stand now! Thank you for all your help.... I will win this (she says) - feeling much more positive
