    Hi, I am in desperate need of help regarding selling my property via Connells and Visum. I'd like to say now that the problem is with Connells and not Visum (who are very good). I first had my property on with Visum and then thought I'd go multi and went with Connells. I couldn't fully understand their smallprint so asked some questions before signing. I was told that there would only be a fee if I sold the property through them at a flat fee of 3K including VAT. The agent stated there were no hidden fees and that was the only one I would be liable for. He also said I was not tied in and when the listing was terminated with them that was that. I trusted him and signed the agreement.

    I realised, very quickly, that I had priced the property too high and that with the agency fees added on I wouldn't get a buyer. So, I asked Connells to put a hold on my property and explained I would be keeping it on the market with Visum to see if a lower price would make a difference. They said that would be fine and they took the property off their listings but failed to take downt he for sale board, they would only remove that once I had terminated with them completely.

    In the meantime I have had an interested party. He has not put on an offer yet. I had the agent from Connells shouting at me down the phone accusing me of diddling them and that I owed them 3K and would not believe me when I said I hadn't had an offer from them or yet an introduction. I told them that I would terminate my agreement and they accepted and the board came downt he following day. I wrote a letter of complaint to the agent and ten days later I have had one back... more on the letter later.

    During the time it was up with Connells (1 week) they sent one person around, an elderly gentleman, who was under the impression that the property was vacant and derelict. They gave them the sales details and sent them round and made no mention of it to me. The gentleman said there and then it wasn't for him. Since then I had another gentleman come round saying he had seen it with both Visum and Connells on Rightmove and had spoken to Connells because they were local to him. They said the property was on hold and so couldn't introduce him to me. He tried a couple of times with them and they ended up having 'words'. Connells never mentioned this to me. He then came round and saw me directly but his interest was with the new lower price that he had seen again with Visum. He has made no offer as yet but does not want to have any dealing with Connells due to his bad experience with them.

    I have since had a letter from Connells, which I don't fully understand, saying that they are now writing to confirm that there maybe additional fees (they don't say what they are or what for) and that I may have to pay a dual fee if I sell my property within 6 months of putting it on with them - even though the contract has now ended. They never told me any of this and I did ask them before signing the contract.

    What do I do about this - with regards to Connells and the buyer (they are two seperate things) can Connells sudden'y spring on me that I would have to pay dual fees and they amy have additional charges? how do I explain this to the potential buyer without putting him off?

    Please help - very stressed and confused!

      Complain to the NAEA


      Estate agents are not regulated, but the trade associations they belong to have codes of practice and conduct for their members, and will handle complaints.
      If you're unhappy with the services you've received, members of the National Association of Estate Agents (NAEA) are bound by strict rules.
      Check the NAEA website to see if your estate agent is a member.
      The NAEA will take disciplinary action on your behalf if your agent hasn’t protected and promoted your interests

                  You are probebly due to pay both if the properfy sells within fhe period mengioned in the co tracts. U
                  But you may be able to negoteate between them. To spljt o e fee between them.

                    But if I asked about this and was told that I would only have to pay a fee to them if they sold the property surely that is wrong. I was told duel fees if on with sole agency but I took the multiple agency option (with higher fee). Surely they can't legally tell me one thing (because I didn't underdatnd the contract I asked before I signed) and then do another thing?

                      Depends on what you signed You signed a contract I expect that they can legally enforce and will no doubt.

                      Bailiffs lie as they say on here Estate agents are lower than that

                        if you sale the property then that is it what you signed stands, if you signed dual contract that is it,.

                        I was selling my property for years, then gave up because of the crash, then I had more estate agents around and listened to them, made my mind up and a few hinted to me be careful of certain estate agency, I actually took on the said agency, low and behold their marketing was 100% better than all the so called big Agencies, and after 5 viewings property sold in 5 weeks due to their pictures/professionalism.

                        exchanged contracts within 4-5 weeks. get on with selling your property and stop worrying about the pennies if you are serious, move on .

                          I have to worry about the pennies, If I go any lower selling wont be an option as I wont have the money to move. If I have to add 3K on due to estate agent lies then I will lose the buyer. ŁK is also not pennies to me.

                          I will try and copy the contract on but having issues with scanner.

                              Hi tufti, i was a property manager for many years.

                              The details will be in your contract, if you post it up i will have a look, but, 90% of agents purchase there contracts instead of drawing them, themselves, and they are top quality, not something you can usually get around.

                              I do think yiou have some room for negotiating with them, due to the curcs that you mention, but, you have to be realistic, it does not matter what they sya to you, what matters is what's in the contracts.

                              Some of the things you mention are typical agents tricks, like sending people round that have no intention of offering the full, price, or investment LLs looking for snap up property's. Post up both contracts, with personal details removed, and some of the others will have time to have a good go through them, .
