  • BT - Can I claim breach of contract

    In mid July I had renegotiated a new deal with BT.

    I had complained I was unhappy with their constant price increasing.

    They agreed to a new 18 month contract with the following terms "As agreed I’ve re-contracted your line and broadband package and this will now be £45.49 a month but discounted to £20.99 for 18 months. The Anytime calling plan at £9.50 a month will remain the same."

    On the bottom of the order, sent the same day after the conversation it read "Any price increases shown above will happen from 16 September 2018 onwards. That means you'll pay the lower price up to and including 15 September 2018"

    In August my bill had gone up from £30.56 to £32.69 when it should not have gone up clearly by what the order suggested.

    When I got Septembers bill in yesterday, a further increase had incurred, and my monthly bill is now £34.69.

    I have no idea why my August bill had increased when the bottom of the order clearly stated that the increase would occur from 15th September.

    If that is the case do I have BT for breach of contract by increasing my bill before the 15th September?

    It would be quicker (and free) to complain to their internal department, get a deadlock letter if they refuse what you ask for, and then go to the Telecomms Ombudsman

        Its funny how the contact I am dealing with at BT is now out of the office until the 28th September. However I have sent her the invoice that was dated the 19th July totalling to £30.49 before the 16 September, then £30.99 after the 16th September. I quoted that August bill was then £32.69 and September went up further to £34.69. I have quoted that I am disadvantaged financially under clause 17b as my order/invoice did not match August/September bill.

          They also said that they would charge me a termination fee of £308. As I only have phone and broadband service, Ifail to see how they can come by this whopping figure, which is why I quoted clause 17b to try and get the termination fee waived.

            Shouldn't your bill have been £20.99 plus £9.50 = £30.49 ?

            What was the quoted rise due in September ?

            Also, were there additional charges ( premium rate calls etc ) that fell outside the anytime plan that account for the changes ?
