    I think your claim will be on the basis that the breeder misrepresented the parentage of the puppy.
    When you bought the animal you received a pedigree form which showed the sire as XYZ and the dam as ABC.
    One or both of these must be false as those two animals could not throw puppies of the colour you purchased.
    You will need to prove that.

    Your loss will then need to be quantified on the basis you were lead to understand the puppy was correctly registered on the Breed Register for pedigree dogs, but it was not CORRECTLY so registered.
    So you paid the price for a dog CORRECTLY registered on the breed register,where you should have paid for a dog registered on the Companion Dog Register.
    You will then need to get your figures together to work out your loss.

        Would the OP need proof its not got the parentage that is stated? with the Dam gone how can they gain proof I know nothing about the KC and registration but if this dog is a pet and we all know how attached we become with pets what does this registration matter if its that important give the dog back and sue for the money paid

          If the sire and dam were with the breeder and you saw them, did you not query the colour of the pup you bought?

            If the mother has passed on then a sample could be taken from a pup from a previous litter that has been registered. It is not simply a case of giving the pup back as they only have a finite shelf life. It appears the pup was not as advertised and therefore should have been at a lower price point. The pup was bought on the proviso it would be KC Reg and as it cannot be the OP needs to sue or negotiate for the difference. If there are letters from the KC and other recognised Breed organisations then really I don't think the Breeder has a leg to stand on.

              I'm hoping the fact that all relevant bodies state this will be sufficient. That the fact the reg was voided specifically because stated parentage was impossible, will be enough. But I'll also try to get more supporting evidence, particularly about the genetics, as part of my court pack.

              Giving the pup back after this amount of time isn't an option, for the reasons you outlined. I'm sure the breeder is aware of this and relies on it. Given the fact they've created this mess, done nothing from start to finish to resolve it, including the most obvious solution, dna testing when they could, I don't think it's unreasonable to sue for the difference between what I got and what I paid for.

                  Both alleged parents were present when I collected the puppy. And no, I didn't query it because I didn't have a clue this breed genetics were so cut and dried colour-wise. I'd obviously been following the 'for sales' for a while for prices/location etc and I'd seen multiple litters advertised with both black and liver pups. I just assumed mixed litters were normal. In hindsight they must have had black/liver parents. It's one of those things that never occurs to you until someone explains why it's not possible.

                      Basically if a dog is "liver" it carries two recessive gene "b".
                      When dogs mate they each pass on one gene.
                      As they both have only the recessive gene "b" that is what they pass on, so any off spring will be liver.

                      Liver is not a dilute colour, but a different colour of eumelanin.
                      As they only carry that colour they cannot pass on any other colour!

                      That is a non technical description.

                      The OP's chagrin comes from the fact she bought a dog and was lead to believe by the seller/breeder that the dog was from a
                      particular mating.
                      Those not in the dog world often believe that KC registration automatically is some sort of guarantee of quality.
                      It is not.
                      There are as many scammers in the dog world as elsewhere.
                      If you want a particular breed of dog the advice I always give is to contact the breed clubs, talk to the breeders and ask their advice about which breeders are having pups.
                      The breeders know each other and will know if there is a problem within the breed.
                      And yes, they can be cliquey, and for a quality dog you will pay a premium.
                      However you should get a premium service.
                      The breeder from whom we got our current salukis will board them for us for free if we need it, and will take them back if for any reason we can't keep them.

                      Many breeders use third party stud dogs, so it is quite normal only to see the dam.

                      Dodgy breeders know that animals become part of the family and this makes it difficult for the new owners to take action.
                      This is part of their calculation.
                      The OP is looking to retain the pup, and for the return of some of the monies paid.

                      I don't know what breed the OP has purchased, but the difference between a quality show pup and one of unknown parentage can be considerable. In "my" particular breed the price can vary from as low as £200 to over £1000.

                        This is a bit cheeky on my part. What I would like to find (to be a part of my court pack) is an equivalent site or text that spells it out the same way for my breed. I'm sorry for being oblique, but you never know who is reading. If anyone thinks they could help, just shout and I'll message you the breed/price paid. I have looked btw but couldn't find anything 'easy for a court to digest' type thing.

                        Just out of interest, the chap at the KC who the three owners talked to/dealt with, and who ultimately voided the registrations, was a lab owner and breeder. It's why he was so certain of the breeding discrepancy.

                              The KC run an Accredited Breeder Scheme. Unfortunately it is a misnomer and anyone can apply to join (including puppy farmers) - after all it is a KC money making scheme. If you take note of my avatar you will see what breed I used to have. Ran one of the Rescues for this for some 20+ years and we were fortuate in that we had one of the countrys' leading geneticists as one of our established breeders. Most Breeds do have a Breed Council and if your breed does have one then some questions to them may bring some good results. Details should be on the KC site.
