      Not a problem.
I have left a message and your link on your behalf and maybe you should receive a response later on sometime, will keep a check on your link, or meanwhile someone else may be along who is good at putting letters together.

Hi Eryca, Di has asked me to take a look and see if I can help with a letter. It appears that you sent LTSB the excellent letter which Caspar suggested in post #57 in November last year.

My suggestion would be that you send them a copy of that letter (marked 'COPY LETTER') - along with an up to date IE sheet. Attach this to a covering letter, explaining that you are still awaiting their proper response to this. Send this to the person who sent you the acknowledgement of that letter - BY NAME. Something like this, perhaps:-
        Dear XXXX

Please find attached a copy of the letter I sent to LTSB in November 2010, explaining my financial circumstances, suggesting a remedy, and asking for assistance and a response to this.

Your letter of XX/XX/XX confirmed that you were looking into this for me, and that I would receive a response. To date, I have had NO FURTHER RESPONSE from you about this.

As it has now been OVER THREE MONTHS since I sent the letter originally, I must respectfully but firmly insist that you respond immediately. I am sure that you will agree that this matter has gone on for far too long, now, as your non-response is clearly in breach of the Banking & Lending Codes.

Please find attached a revised copy of my IE sheet for your attention.

Please also be aware that, if I do not receive a timeous response to this communication, or to any future communications with you, then I will be forced to assume that you are not prepared to enter into a proper dialogue with me over this matter. In such circumstances, it will be deemed that you have confirmed, by default, that you are not interested in resolving this problem - nor in recovering any alleged debt.

I am sorry to have to take this stance with you, but you seem to have left me no other choice.

If you continue to make charges to the account and send me demands for payment, yet you ignore my attempts to resolve matters, then your conduct thus far will clearly not be seen in a very good light by either the FOS - nor the Courts. I would therefore suggest that you consider it in your OWN interests to now deal with this matter in a reasonable manner, and I look forward to your considered response.

I thank you in anticipation of that.

        Yours sincerely

I hope this is something along the lines of what you need, Eryca. Please allow others such as Leclerc & Caspar some time to make suggestions/alterations - or trash it, if need be !!!

one more question, do I have to sign it or just type my name on the letter?

                  Your very welcome.

I normally sign mine to be honest, but see what everyone else thinks if you want more opinions.

                  Good luck.

Sign it - in BLUE ink.

Then print your name below that.

I forget exactly why......Just do it, OK ?

Looks good to me Erica - told you I'd be lurking in the background! lol

Its clearly gone on far too long and needs sorting. This should hopefully encourage them to address things slightly faster.

hi everybody. I v received a letter from lloyds admiting they have missold me a bank card, they apologised for many things but they also twisted my words.

they paid off the overdraft charges (what occured after I sent the first letter of) but I am not sure whether they debited £300 to my account so it has brought me back to £0 or they gave me overdraft limit of £300 (I will have to check).

they also said they will send me £50 as a compensation and if I am not happy I should contact them again or contact the FOS.

any advice how do I take it further? I paid £8 each month for 3years while I have been banking with them due to misseling the bank card, furthermore due to these card charges I have occured more bank charges which have made me take the loan as it has gone too far.

they gave me a phone number to call but do not want to talk to them on phone I will rather have black and white hard copy so I have proof about the conversation.

                          any suggestions?

                            Hiya Stranger,

Brilliant - the letter did achieve as result afterall combined with Bill's excellent letter above.

£300 is fair compensation as you in 3 years would have paid £288.00. I'd also graciously accept their £50 compensation BUT only on condition that you spell out clearly to them as a direct result of being missold the card you had to take out a loan on which you are incurring charges. They need therefore to refund any charges and interest already paid and turn this into an interest free loan so that it puts you back in exactly the position you would have been had you not been missold the card in the first place.

Is the account now closed. If not you need to close it to avoid further charges which they would presumably continue to charge you now you know the position on the account.

I feel a letter coming on if you'd like, but I don't think I'll have chance to do it till Monday or Tuesday. All it needs to do is point out the above -ie- you should be left after their settlement in the same position you'd have been in had they not missold you the card in the first place. I think they're more likely to do this if you accept what's been offered graciously, but conditionally.

There's also the matter of your CRF - what does this look like after all of this? Are there things on it that need changing, or as an overseas student is this not applicable to you?

                            Caspar

I dont think I can close the acount as they put the loan on it. is it still possible to do that?

with the £300 they paid back all the charges what they added to my account since I have sent them the first letter and the response clearly says that they refund my overdraft charges and not the card charges what occured in 3years.

how can I make my loan interest free than - it ll be ok for next week yes.

                                what is CRF?
