  • Capital On Being Uncooperative

I would like some help please with my credit card provider Capital One.

Out of my 6 creditors, Capital One are the only one who is being uncooperative in request for a debt write off.

I owe 400 across 2 credit cards with them.

Last year I made a formal complaint in writing in August 2017 I had their final response.

In this, they admitted in writing that they did not do a creditworthiness assessment because they felt one wasn't needed.

At the time of the giving me 2 credit cards, I had 4 creditors, and I owed well over 10K in debt.

How is this responsible and surely a breach of guidelness under chapter 5.2.2 of the FCA they do have to undertake a creditworthiness assessment!?

They are so far still refusing to write off this small amount of monies, even though I have provided a detail income and expenditure sheet.

I'm banging my head against a brick wall.

Any advice on this creditor who is being clearly uncooperative?

If you have had their final response then you should complain to the Financial Ombudsman Service.
HOW TO COMPLETE AN N180 DIRECTIONS QUESTIONNAIRE (SMALL CLAIMS TRACK) FORM?

My posts on this forum are offered based on my experience dealing with a variety of life events. I have no formal legal training and if in doubt take professional legal advice or contact the CAB. If you follow anything I write on this forum you do so at your own risk and I accept no liability for any loss, costs or other outcomes.

I do not come on here in the evening, at weekends or on public holidays.

Their final response was dated August 2017.

Is it too late to go to them with it!?

The way I understand it is that you have 6mths from the company's final response to complain to the FOS - http://www.financial-ombudsman.org.u...volved_a7.html - although they will look at out-of-time complaints if the business agrees
