  • County Court Claim vs VCS_BW Legal

I have received a County Court Claim yesterday 15 March 2018. Relating to BW legal acting for VCS for PCN back in 2015. I made appeal against it through Independent Appeal Service (IAS) indicated in the PCN. They refused my appeal and when I received the decision notification, I went online I made the PCN payment of £60. Then some time 2016 I received a letter from vcs demanding £40 as part of the PCN. I explained to them and gave them my payment reference. I was told I have to pay that as my appeal was rejected. I refused and never heard from them until I had a letters from them and BW legal in 2017. and calls upon calls from BW Legal until now, a County Court Claim of £183.48 dated 13 March 2018 and given 14 days to respond.
Please can any one advice me the way forward

It would be helpful if you could post a copy of the claim form (with personal information covered) to allow people to see exactly what the claimant is claiming against you.

ostell is good with parking and much better placed to ask the right questions, then help you out.

Just answer the question once they post, good luck.

So they are not quite telling the truth about that £40 on that claim form. What does the "contractual costs" refer to? There can be no terms and conditions on the PCN, it was issued to you and they cannot impose additional terms by way of a letter. Have you got photos of the signage?

Have you got the original Notice to Keeper that they sent you? Did you identify the driver? Yes or No/

I was the driver and I appeal to them with the circumstances we as a family were in. My cousin child died in the hospital and I was the one arranging the funerals and my own child was ill as well and we went to pick up prescription at the pharmacy. I drop my wife and went into the car park to park my car and join her. As I went into the car park, I had a call from the funeral company to go through some details with them. My engine was still running whiles talking to them my wife got into the car and we drove off to meet the Funeral Directors.

I accepted the fact that I have been parking there but that day was a one different day I do not wish to remember. I paid the £60 PCN after they refused my appeal and they are now chasing me for additional £40 because the payment was after they refused my appeal.
