      Excellent thanks.

When it comes to including it in your witness statement we'll include both e-mails to make the context of the one you got from HMPO clear.

If you can send it via MCOL then yes (although I know some people have had problems logging in recently) xx
If you can't get onto mcol, you could email it to the court as a pdf attachment (with your name vs BPS defence as a subject line) - the email address should be on the claim form

              Hi Amethsty

I have received my 'Notice of Proposed Allocation to the Small Claims' asking if I wish to go through mediation? But i would think if I say yes then I'm admiting that they would have a case against me!!!

Today though I have been sent this E-mail from UK Services

              Dear Ms Tomlinson,

Thank you for acknowledging our Court Claim.

We hope that like us you are looking forward to an impartial Judge putting an end to this dispute by deciding based on the facts and English law which party is correct.

The court has now furnished us with a copy of your defense which we have read and have a few questions about and so would you be kind enough to book an appointment via www.BookPhoneCall.com so that we can discuss this matter with you? There will of course be no charge for this telephone call.

As mentioned before issuing proceedings we still have the desire to resolve this matter without having to go to trial and we did select "yes" to the question regarding whether we would be interested in resolving this matter via the courts mediation service. If you have also advised the court that you would be interested in working with us to resolve this matter then the mediation team will in touch in due course. We are more than happy to fit in with a time and date that suits you and will ensure that one of our agents are available for the call anytime between 9pm to 5:30pm Monday to Friday.

If you did selected "no" to the mediation service but are interested in potentially settling this matter without needing to attend a hearing simply click here and send this email to the court.

On another note should at any point you wish to settle this dispute simply visit: LindaT.settleinvoice.org.uk

If the £202.60 (cost breakdown here >>) is paid before the hearing date you will not need to attend a hearing nor would a County Court Judgement be logged against you should the Judge side with us.

              Kind Regards

Now do I still refuse mediation and carry on defending my case as I don't see they have a leg to stand on with their bullying and pushy tactic by asking me to settle out for court. And also the fact that there was never ever an appointment made??????

              thanks again

Yes say no to mediation and continue with your defence. Once you have returned your N180 you should get allocated to your local court and then receive directions and a court date. Then we can send in your witness statement and exhibits, and you'll get his ones in return.

I would respond very briefly and state that if they have any questions about your defence then you would appreciate these in writing. I think I wrote something for someone else following the same letter a couple days back, will have a look.

Correct, we're suggesting to everyone that they tick no to mediation as there's nothing to mediate about ie you're not prepared to admit any liability whatsoever.

As to the e-mail, everyone gets this. It's completely inappropriate for them to want to discuss your defence with you. Simply respond saying that you don't consider it appropriate to discuss and that if they have anything to say they need to put it in writing.

I've received another e-mail from BPS today and I've copied it here for you to look at before I reply or not to them.

                        Dear Ms Tomlinson,

We respect your request and have made a note on our system.

We saw by reviewing your initial defence on Monday that you appear to have copied and pasted an email from the Liverpool Passport Office stating that the appointment we secured for you did not exist. As per our policy we do not pursue claims where this is the case regardless of whether it was an error on our part of Her Majesty’s Passport Office’s side.

Please forward this email from HMPO so that we can check for its validity.
