  • Unfair PIP Assessment

    Just had my face to face assessment today and am feeling that it was unfair and wondering if or how I can appeal this.

    The assessor start off asking general questions, then started to ask me about the form (which I have no problems with) but failed to ask what I feel was the major 2 points regarding my condition which is engaging with other people and planning and following journeys, also when it came to the making budgeting decision all they asked was how do I check my in and out goings and if I have online baking and what my hobbies and interests are, which I didn't think was relevant plus when trying to explain things it was cut short cos they moved on to how I got there.

    Hello Chris,

    I have been through the procedure via a so called expert from Capita on behalf of the DWP.

    I have severe Osteo arthritis in both knees. At no time did the representative see my knees or watch me walk.

    I was a whole series of irrelevant questions as you seem to have been as well.

    I was awarded the lower level if the daily living component and failed to reach the minimum on the mobility, even though the rep knew I am totally dependent on my wife to get me around.

    I made an appeal to the DWP, and was refused.

    I am now attending a tribunal this week for the second level of the appeals stage.

    The DWP claimed I was seen by a doctor, which I wasn't and they subsequently changed that to a 'disability assessor'.

    Basically, they will do anything to minimize the award, if any is given.

      When you get your decision the first thing is to ask for a manditory reconsideration, for this you can provide more evidence. Also ask for the assessors report , I put in for my reconsideration before the report was seen so I could not destroy her credibility .The reason they will ask about online banking is that they will take that as meaning you can keep an eye on your money so can budget, I could give them several other reasons. Did you have someone with you and was it at home, they will base your interaction with others on this even though the assesors are trained to put you at your ease.

      In my assesment she said there was a half emoty bottle of cider on the floor, now if she had said Vodka or wine i might have agreed but I do not drink cider , she also said I was able to climb stairs but I let her in through the intercom entry so she did not see that .

      If you lose the mandatory reconsideration go to appeal, you really have to go all the way. I would try to talk to someone from a welfare rights charity or get a letter of support from your GP

        These Pip assessors have been rightly exposed with all their make believe reports the same with my PiP assessment report full of lies, someone legally needs to be investigating this it seems the DWP have not been treating everyone fairly or accurately???

          I am very sorry to hear that you have suffered at the hands of people employed by the government who's job title might lead you to believe that they are caring people who have come assist you in your claim for disability benefits and who's job title could easily make a mockery of the real dedicated hard working Surgeons, Doctors, Nurses, Carer's, Counsllers, (please forgive me for those I have not mentioned) working within the NHS and other caring practices within the UK. The so called Health Professionals working for CAPITA, ATOS and other similar organisations on behalf of the DWP, IMO have been trained to lull you, by chatting about general nothings in relation to anything other than your disabilities, they come across as friendly and caring, to get you to engage into conversation with them, and then sideline you by asking trick questions to get the answers that 'they' or their employers want. Their trickery and training enables them to fabricate the Consultation Report Form as such that it resembles someone other than you, that is much more able bodied and who must have lied on their Customer Questionnaire.

          IMO I would recommend that anyone who has a PIP assessment due in the near future insists that it is recorded with the permission. I will explain why below.

          If I showed you the CAPITA Consultation report form that the CAPITA HEALTH PROFESSIONAL filled in after a Claimants PIP Assessment and gave you the digital recording of that assessment (which the Claimant was advised that he could do, by another well known and informative advisory website with regard to disability benefits) which was recorded for the Claimants own reference, you would see exactly how the CAPITA HP reported bare faced lies throughout her whole report :flypig: of the 1hr 44 minute assessment, and that she used the 'F' word in relation to a doctors handwriting on a hospital report. There are too many lies to mention :tinysmile_cry_t: in what will already be a lengthy post, in short the whole report, in every descriptor was a fabrication, no exaggeration. The original CQ was sent in to DWP with 9 extra pages and the contact details of all the Claimants NHS healthcare professionals, including Consultant Spinal Surgeon, Consultant Neurologist, Consultant Orthopedic Surgeon, Consultant Urologist, ENT Consultant GP, Specialist Spinal nurse, Consultant Anaesthetist (pain specialist) etc., The DWP and Capita wrote to none of them, they did not even ask the GP to fill in the 'Statement of Fact' form.

          A further 8 pages of evidence were sent to the DWP by recorded delivery a few days after the Customer Questionnaire but the assessment was so soon (7 days including the weekend) between the DWP signing for the CQ and the assessment itself) that the assessment had been and gone before the DWP signed for the 8 pages. During the assessment the Capita HP was handed a further 48 pages of medical evidence which she refused and handed back saying "we are only allowed to use 1 letter" (all of this is on the recording). After the assessment ( date the 3rd) The HP was asked what should the claimant do with the 48 pages of evidence, the HP said to "send it to the DWP, you should get a decision 6-8 wks." The 48 pages of extra evidence were sent by recorded delivery, at 16.59hrs on 12th the DWP signed for them at 08.07hrs on 16th, on 17th the claimant received the decision dated the 13th. DWP did not receive the 48 pages of extra evidence until 3 days after they had made their decision. So the DWP could not have considered anything in relation to the claimants claim other than the what was in the CQ, but in saying that, the contents of the CQ had not been considered all, given the outcome of the decision.

          A complaint was made to Capita about the HP's conduct firstly by phone and then in writing, no action was taken, a second complaint was made to Capita in writing and rather than them respond in writing, the complaints department phoned the claimant to say that no action is going to be taken as they will not listen to the recoding of the assessment in regard to the complaint.

          A mandatory reconsideration was requested along with extra time to prepare the evidence, both of which the DWP allowed. The claimant kept the DWP informed of his progress and further time was requested and again allowed, then the DWP made their reconsideration before this extra time had expired without the further evidence.

          So in this case the claimant is awaiting appeal and none of his evidence has been considered so far by the DWP. To add insult to injury the DWP have objected to the appeal.

          The claimant has written to his MP, the MP was so alarmed by everything that he wrote to the Minister for Disabled People, who in turn made enquiries to the DWP and Capita. The response that came back was basically generic dribble more lies from the DWP and Capita. which was believed by the Minister for Disabled People and the claimants MP. Basically the DWP and Capita are jumping up and down because the claimant recorded his own assessment without prior consent of the HP which is disallowed, they have shown no interest whatsoever with regard to the ROGUE HP using the recording to cloud the real issue.

          Capita's telephone response to the second complaint was, "the claimant has got to prove the assessment unfit for purpose, and by the way, no one is allowed to take the recording of the assessment into consideration as it was unlawful to make the recording without the HP's prior consent, unless the claimant can lawfully prove otherwise" The DWP has said much the same, I wonder why??

          HOW IS ALL THAT FOR A LAUGH?? - THE SYSTEM STINKS!!!

          IMO I would have thought that the CAPITA HP has committed fraud in making a false statement that has resulted in the claimant losing half of his Disability Benefit. The DWP and CAPITA have assisted the HP's abuse by covering it up her behaviour. This HP remains employed where she clearly abuses the trust of vulnerable, sick and disabled people and takes away their lifeline in many cases.

          The claimant, in this story was receiving DLA High, High until the DWP reassessed him 4 months early for migration from DLA to PIP. He has had his mobility component taken (car and blue badge) away which has hugely impacted on his life, he has paralysis below the waist and he lives 10 miles from the GP, Pharmacy, nearest shop, and is not on a bus route. A Taxi to the shop is £30 each way. His care component has been reduce so he is unable to receive as much care as before and already had suicidal ideation before his benefit was cut because his paralysis was as a result of someone else's negligence which changed his life completely over night with no prospect of recovery.

          The very, very sad thing is that the CAPITA HP that assessed the claimant in this story, will not only have assessed this claimant in such a way, she will not be the only CAPITA HP to act in such a way. Disabled people will be affected by these ROUGUE CAPITA HP's every day, of every week, of every year, and sadly the misery that comes as a result of their conduct is bound to result in loss of life. Such behavior is IMO criminal, yet CAPITA and the DWP sweep complaints of such under the carpet. I wonder why?? SHAME ON YOU!!!

            Had my PIP interview with a so called medical professional from Capita. The statement was full of lies I am now awaiting a tribunal date.. she wasn't interested in what I had to say she even told me she hadn't got time to listen to me, I think she had already wrote the statement before she even saw me.

              Every claimant should call social services for help.once you have access to a worker,either social worker or support worker, you may then have access to welfare rights team..They can assist you legally. Good luck
