  • Destroyed documents by the Benefits Agency

    I have read that you can only sue the DWP for an offence. Thanks by the way to all comments and answers. Would l be correct in saying that the Housing benefits office destroyed all my original personal, private, sensitive, bank and pension details after sending them to apply for a claim. This office has kept lying and ignoring my requests for answers for a year now. Also do they have a right to destroy personal documents? Hope you can advise me on this. Jeff69:juge:

    Hi Jeff and Welcome

    You're probably best starting a new thread rather than resurrecting an old one like this - you will probably get more response.

    You will also need to give a few more details of what your complaint is.

        If you go to the home page for the form and in thiis case "Social Welfare, Health and Benefits", on the left hand side about a third of the way down, there is a blue button "Start a New Thread".

              Hello everyone who is trying to help. Yes, all the documents including bank statements, pension details, private pension details, savings, p60's and all the other stuff l sent were originals. The Benefits Agency (BA) ask for all these to see if l qualified for rent or council tax benefit. This has been going on for a year now with lies being told to me that all documents were returned, then another staff member from the BA telling me they were shredded, all my emails being ignored and the manager not being bothered to reply. Only when l contacted my MP who wrote to the BA did l receive a phone call and that was it for another two months. Then l contacted my local councillor who wrote to the BA, which then sparked a call from the business manager who promised action, that was seven weeks ago and still nothing. Now l am not even bothering to contact the BA, but have wrote with copies of most of my emails to the Director general for Operations in London to see what they say. Before l wrote to them l sent letters of my emails that l sent to the BA to DWP ICE Gateway Team, Independent Case Examiners Office who say they cannot help, hence the letter to London. Now all l can do is wait for them to answer, l sent the details by Post Office Tracking and these have been diverted so l don't really know when they will get them, l will keep my eye on this but am searching other options if they too are not interested. Once again l appreciate any help given. Regards Jeff69

                Jeff you would be better keeping to One thread otherwise it gets confusing for anyone trying to follow the "plot"

                  nem - my fault, I suggested a new thread was started rather than the 2 year old one about JR'ing the DWP

                    Ask your mp to refer the matter to the Parliamentary and Health Service Ombudsman, not to the DWP.

                      Are you sure it was the DWP?

                      They don't do housing benefit or CTB, those are administered by the local authority - in which case the PHSO won't be able to help, the Local Government Ombudsman may.

                            #One of the first things you need to do is get new copies of the documents. Particularly letters of entitlement and similar . This will take take time and be a pain but believe me this is a good thing to do . Also get a recording app for your phone and record what the little so-and-so's say.

                              Documents such as P60 's cannot be replaced unfortunately.
                              With the state of Limbo due to the Election it will be difficult
                              for you to obtain help from your MP.
                              Were the documents sent to a local benefits office (JCP) or to a DWP main office.
