Hiya, I'm new here, just joined this second. I havn't a clue about law just bits and bobs i've picked up. I was wondering if anyone knows a solicitor who would be prepared to take on the DWP as all the solicitors I've tried claim they don't do it, or don't have the expertise to deal with such matters. I know they're all fobbing me off, I know they are all corrupt just like the whole legal sysytem. I want to sue for fraud and harassment. I am prepared to go it alone if I can't find an honest solicitor with some balls. I'd be so incredibly grateful if anyone can help or give me some advice, Thanks a lot Robert :-)

Re: Suing the DWP and ATOS
lol id be here all day, but basically, ive been founf fit for work 6 times after ATOS medicals, I've won one appeal which was the first, every one after that my money was reinstated after i sent a letter, they didn't go to appeal. The last medical I attended wither the doctor or someone in the benefit office changed all the answers i gave, which is fraud. I mentioned all this in the letter and had my money renstated once again. ^ times is harassement. But anyway, After i told them about the fraud comitted, there was no investigation or anything. I have just received a WCA for and expect to be called for another medical which i will not be attending, and to be honest, they have a cheek sending me for another medical after the said fraud. I will not tollerate this. Like i said, id go it alone if need be. I simply wont tollerate being treated like this. As a freeman of this country I have rights. Seems to me all solicitors and the whole legal system is corrupt, and i will fight them to my last breath I swear. Thanks btw for your quick reply :-)

You might find it easier to sue the "healthcare professional" (sic) who carried out your "assessment".

Re: Suing the DWP and ATOS
publiclawsolicitors.co.uk are the solicitors who represented Cait Reilly in the Poundland case and they have represented other claimants in high-profile cases against the DWP.
You may want to contact your MP about the behaviour of DWP too.Last edited by Amethyst; 27th October 2015, 11:38:AM.

Thanks, ill try that tomorrow, im knackered, i spent the last two days on the phone trying to find a soliciror. Is it just me or does anyone else find it a tad strange that no solicitor is prepared to take on the dwp or atos? Over the past few days the most important things ive learned are 1. A solicitors first duty is to the crown, not the client. 2. There is no real justice. And 3. The whole system is corrupt.Last edited by Amethyst; 27th October 2015, 11:38:AM.

Re: Suing the DWP and ATOS
A few things you might wish to consider -
1. Forget about Freeman On The Land theories. They don't work;
2. The DWP employee who changed the answers you had given not only committed fraud, he/she also potentiallly committed forgery;
3. If you know how the law works, you can make it work to your advantage;
4. Justice is there. It is a case of standing up for it and not giving in.
5. Yes. We know there is corruption in the system, but by exposing it, bringing it out into the public arena and embarrassing those who are allowing it to flourish, it will be overcome and stamped out;
6. Never say never;
7. Never give up.
I have found out myself just how corrupt, incompetent and mind-bogglingly stupid the DWP and ATOS can be. Ask your MP to obtain forms for referring the matter to the Parliamentary Ombudsman should this become necessary.Life is a journey on which we all travel, sometimes together, but never alone.

Re: Suing the DWP and ATOS
If you have to go for another medical can you take somebody in with you, so if they do change the answers yet again then you have somebody who will be able to offer evidence that they did this?
The whole ATOS involvement is a nightmare and many vunbersble people are victims but just don't have the strength or ability to fight against it.
Well done for standing up to them and having the strength to fight. Good luck with your battle and I wish every success in your quest. I'm sure everybody at LB's will support you anyway we can and would really like to see you victorious xxx

Re: Suing the DWP and ATOS
Conspiracy theories are not going to help you or make your case more credible. The vast majority of solicitors have not got the experience to handle a case against the DWP and ATOS because this is a specialised field of work and not something that you can simply dip a toe into and try it out. That does not mean that they are corrupt, in cahoots with the DWP, or against you. It means that they are unable to take the case either because they (a) do not have the experience to do so, or (b) if they do, they are not satisfied that there is a case to be made. The vast majority of lawyers also require paying - taking on a case of this sort could be very costly, and if there is no prospect of you paying, then in most cases someone else has to. Few lawyers will take pro bono cases directly from prospective clients.
If you are unable to fund a case yourself, which I suspect is the case, you would need to have your case recommended to a pro bono panel for either solcitors or barristers. The starting point for this is generally your local CAB or Law Centre who make the initial assessment and recommendation.

Nah, I'm not going to any more atos medicals. Whoever changed my answers probably did it long after I'd left I'll prolly once again have my money cut of course, but i couldn't live with myself if i gave in. I'd sooner die than be a slave.

Re: Suing the DWP and ATOS
When you get down of your soap box you will realise that you have been given some good advice here, now my advice to you is take the advice you have been given, go to the next assessment and stop trying to cut your nose off to spite your face, all you will succeed in doing is causing yourself more financial troubles and make yourself feel even worse.
No ones calling you a nutter, Eloise is giving you the best advice available and for free.
