  • DWP bureaucracy is killing me!

    IN SHORT, HOW CAN DWP TAKE ELEVEN WEEKS TO MAKE A DECISION ON AN ALREADY 'DECISION'. BUT ONE THAT LEAVES ME FINANCIALLY (AND MENTALLY) DESTITUTE. HOW CAN I CIRCUMVENT IT - KNOW ANY 'MUSTARD' LEGAL?

    Since '97 - diagnosed ME, I have received DLA; namely Higher mobility and middle care components. Every three years enduring the acutely stressful Appeal Tribunals. Yet, without fail (so far) the panel has awarded entitlement to both HIGHER MOBILITY AND MIDDLE CARE each time. But at such debilitating cost to my ME. [I also find the form filling and general bureaucracy exhausting].

    My latest renewal, whereby my ME has more seriously debilitated, I explained this and its repercussions and I (stupidly) mentioned I hoped as a consequence I would not be pushed to Tribunal this time.

    Now DWP 'decision' is I retain Higher Rate Mobility BUT (illogically) am only entitled to lower rate care! Thus approximately £35.00 less DLA per week. But also, my Pension Credit will also be reduced by £55.30 per week; totalling £85odd less to live on.

    I am already struggling to survive on my meagre state pension (I also must pay £36.00 pw storage fees because my L/Authority refuse their duty to pay these by refusing to acknowledge my homelessness). Thus weekly, overall, I will now be £121 worse off. I have no savings, other income or anyone to borrow from - not that I would anyhow (ruination of acquaintances)..

    After 4 hours phoning DWP (from jobcentre Plymouth phone thankfully) I am told my GL24 form (appeal their decision) will take 11 [ELEVEN] weeks before they can make a decision (on the original 'decision')! At 6 [SIX] weeks thereof, they will write to me advising they are still working on my case/that I have not been forgotten (gosh!). BUT, if thereafter they STILL decide I am only entitled to lower rate care, I can then begin to appeal to a Tribunal for which there is a 6 MONTHS delay before maybe being heard!

    Meantime, I am supposed to 'bite the bullet' and survive on an ultra reduced income - far less than the 'Government says ... need to live on'. I am already suffering malnutrition and its consequences on my health.

    I have fully worked and paid my dues to this country for 50 years. Will anyone aim a well directed kick that 'encourages' DWP to better their despotic antipathy attitude? HELP, please?

    You can take DWP to JR if necessary, there is an urgent application option which can be used if you are destitute. If you have a Law Centre
    near you, they should be able to help.

    It may be worth speaking to your MP first, as my experience is that political pressure can be more effective than legal appeals with DWP.

      There are charities and benevolent funds which may be able to assist you in the meantime eg the somewhat quaintly named Society for the Assistance of Ladies in Reduced Circumstances or Elizabeth Finn Care. Some of them are linked to particular occupations or geographical situations. The site Turn to Us helps you find out what you are eligible.

        I know it may sound bizarre, but they may be trying to help you. I had similar with my DLA and the Consultants wrote asking the same as you requested due to toll it took on my health. This resulted in the obvious component being awarded at the higher rate, and the other, by default, at the lower.

        The appeal process is gruelling, and increasingly so I suspect since the changes. Last time I did as Springer has suggested and involved my MP - they took things on and got it sorted for me comparatively fast.

            Agree that using your MP to sort this. They have the 'clout' to push things fast

            I use E-Mail when I want to contact my MP, they have to answer. Chase up the e-mail if it is an urgent issue!!

            Keep copies of the e-mails you send and receive from your MP

              You have my sympathy
              I was diagnosed with M.E. in 2007
              it only took nearly 8 yrs to get a diagnosis
              I have applied - asked for a review - gone to tribunal (although didn't attend as I'm too ill (supporting letter from specialists etc in support and stating that I was unable to attend)
              3 times since my diagnosis !


              I have now had 2 heart attacks
              2 angioplasty's with stents fitted
              I have blocked carotid arteries 81% and 51 % blocked (which is affecting my eyesight due to lack of oxygen)
              I have osteoarthritis, TMJ, degenerative disc disease in my spine and several other health problems
              Of course I was treated like a hypochondriac by the GP service (for more than 10 yrs now)
              told that all my symptoms were caused by the M.E
              Begged them to do a heart scan because of my symptoms and family history of heart problems

              Was told that they couldn't do tests like that willy nilly!
              I applied again in April this year, they didn't get it till June because it took the person who completed the forms so long to give them all the information lol
              I've also got the 'you should hear from us in 8-11 weeks' letter
              Someone professional filled in my forms this time, as I didn't know what else I could tell them that I hadn't already and the paperwork from all the past claims, 3 copies of my medical file and all the letters of support and info from the medical profession already filled 2 boxes -I just didn't know where to start and my brain fog etc just wouldn't even allow me to start reading it all!
              If I wrote about all the problems I and my family have had with the medical people - it would be a novel :-(
              I would love to email my MP about it all and about the way my mum was treated/not treated in hospital during the last few weeks - she passed away on Monday :sad:
              I haven't got enough energy!!
              It just seems to me that if you are really ill (particularly with multiple health issues) and a genuine person ... nobody is interested!
              The words on the Nice guidelines for M.E alone are a joke, they spent money producing these ... and what for?

              What is the point in there being myriad pages of info 'telling you what you are entitled to' when you can't find anyone to sort things out or tell you why you're getting nothing!

                There is a charity Action on ME who I have had contact with, they seemed quite good - have you found them helpful at all ?
