IN SHORT, HOW CAN DWP TAKE ELEVEN WEEKS TO MAKE A DECISION ON AN ALREADY 'DECISION'. BUT ONE THAT LEAVES ME FINANCIALLY (AND MENTALLY) DESTITUTE. HOW CAN I CIRCUMVENT IT - KNOW ANY 'MUSTARD' LEGAL?
Since '97 - diagnosed ME, I have received DLA; namely Higher mobility and middle care components. Every three years enduring the acutely stressful Appeal Tribunals. Yet, without fail (so far) the panel has awarded entitlement to both HIGHER MOBILITY AND MIDDLE CARE each time. But at such debilitating cost to my ME. [I also find the form filling and general bureaucracy exhausting].
My latest renewal, whereby my ME has more seriously debilitated, I explained this and its repercussions and I (stupidly) mentioned I hoped as a consequence I would not be pushed to Tribunal this time.
Now DWP 'decision' is I retain Higher Rate Mobility BUT (illogically) am only entitled to lower rate care! Thus approximately £35.00 less DLA per week. But also, my Pension Credit will also be reduced by £55.30 per week; totalling £85odd less to live on.
I am already struggling to survive on my meagre state pension (I also must pay £36.00 pw storage fees because my L/Authority refuse their duty to pay these by refusing to acknowledge my homelessness). Thus weekly, overall, I will now be £121 worse off. I have no savings, other income or anyone to borrow from - not that I would anyhow (ruination of acquaintances)..
After 4 hours phoning DWP (from jobcentre Plymouth phone thankfully) I am told my GL24 form (appeal their decision) will take 11 [ELEVEN] weeks before they can make a decision (on the original 'decision')! At 6 [SIX] weeks thereof, they will write to me advising they are still working on my case/that I have not been forgotten (gosh!). BUT, if thereafter they STILL decide I am only entitled to lower rate care, I can then begin to appeal to a Tribunal for which there is a 6 MONTHS delay before maybe being heard!
Meantime, I am supposed to 'bite the bullet' and survive on an ultra reduced income - far less than the 'Government says ... need to live on'. I am already suffering malnutrition and its consequences on my health.
I have fully worked and paid my dues to this country for 50 years. Will anyone aim a well directed kick that 'encourages' DWP to better their despotic antipathy attitude? HELP, please?
