I am trying to advise a 20 year old Male - who is in receipt of Income Support. He is on a Vocational Course at College and also receives Disability Living Alloance, Housing Benefit and Council Tax Ben.
His College course is due to complete, approx July 2011 - but his dilemma is this - on Dec 11 he will be 21 years old, and it seems that his claim to Income Support will cease from that day; as he is no longer considered eligible under the prescribed category of being 'a vulnerable person/estranged from parents'. As this category of entitlement is only valid, up until a person reaches age 21.
However, it is my understanding that he would retain entitlement to IS (until the end of his college course) by virtue of being 'in relevant education and have a disability'
As I am not 100% of this being a strong or relevant argument, I was hoping somebody with more experience/knowledge of the system, might be able to confirm this for me.
I keep reading various Regulations and Legislation and sometimes I think I have got it clear in my head and the next, feel a bit out of my depth!! Any help or advice would be much appreciated - as want to make sure my advice is accurate.
