  • Mbna 1998 visa credit card ppi complaint

    I applied for an MBNA Visa credit card by post in August 1998 in which I ticked the 'Yes' box for PPI protection in which I fully would not have needed (silly me) as my company provided free health / benefit in death cover etc.

    I sent off an SAR to MBNA in which I received another copy of the postal application details but no policy insurance details regarding the ppi.

    Also on checking the wording on the request form, it only states how the premium is calculated and brief wording about accident and sickness cover but no mention of any exclusions etc and did not receive any policy details. They also recommend that to tick the yes box for peace of mind.

    So on this basis I sent a PPI complaint to them in August 2014, and eventually received a response saying it had been assigned to a case manager and that I should receive their decision within 8 weeks (being the next week).

    Well today I received a further letter advising that I need to complete their questionnaire providing evidence of savings accounts, employment cover etc and that it is to be sent within 14 days.

    Is this again just a normal reply and request, am I obliged to complete and return ?

    Do I also still have a case for complaint and if so should I also respond with a letter mentioning lack of provisions as per the Consumer Credit Act and state various DISP's from the FSA handbook re PPI redress ?

    Any advice would be truly appreciated.

    Bazza, I would say it is normal that they asked for an additional information. The template of the questionnaire was designed by the FOS, so, I would not waste your time arguing with that.
    You can complete their questionnaire, saying the truth, which is indeed in your favour.
    I believe you have a case. They asked you to provide some proof that you had other means to repay.
    I also signed my application and ticked the PPI box. MBNA upheld my complaint after asking for the same sort of additional information.
    I completed all my questionnaires, at the same time enclosing a letter with complaint details in each of my cases.
    There were 3 companies, which did not require to complete a questionnaire, but MBNA always did, which is within the rules and regulations.
    When I had a case with MBNA and they did ask me to provide information about my other means to repay, such as other insurances, savings etc.
    After I provided that they upheld my complaint straight away.
    It is fine to enclose an additional letter of complaint along with your questionnaire, if you have enough facts to mention. (Better to refer to the FCA, which officially replace FSA, not to give them a reason to say that the FSA does not exist anymore, though DISPs are very similar, almost identical in the FCA Handbook now )
    I believe you, being meticulous as it seems , do have all those documents which will support your claim.
    It should not be a problem for you to send them the copies.
    I usually sent everything which would have supported my cases, even copies of my NI contributions.

    Just in case, I would suggest you send them everything by Special (or at least Recorded) Delivery to have a proof you did send it and it was within 14 days as requested.

    If, by any chance, you need more than 14 days to obtain all the necessary documents, then, again, you have to write to them and inform them that you need more time, giving the reason why, such as the organisation, which will send you the documents can do it only within .....whatever time. They will have to accept it as long as you communicate with them in writing, having the evidence that you did.
    Also, in that case, please send it by Recorded Delivery to have a proof that you did.

      Many thanks for your reply and time again.

      I will complete the questionnaire as you said but if you don't mind me asking, did you have all additional documentation evidence to hand ?

      See mine was back in 1998 in which the Insurance company that I worked for no longer exists and probably don't have all the required details. I do still have pension plan / life assurance details and maybe some old payslips around the time that I opened the account.

      Is there any other way in obtaining information or any proof that I had sickness / redundancy / death in benefit cover in which I did, at the time ?

        Bazza, luckily for me I did have all the necessary documental proof.
        I still have the same insurances in place.
        I am not sure what is the best way to obtain the documents from the insurance company which does not exist anymore,
        May be somebody here is an expert on that matter.
        However it sounds like you have enough anyway.
        You can supply them what you have and try to investigate if you can get more.
