  • Barclaycard PPI claim

I took out a Barclaycard in 1990. I paid off the card and ceased to use it in 2003, but neither party formally closed the account.

I complained to Barclaycard for the mis selling of PPI initially in 2011, but received no response. I continued to complain but they couldn't find any record that I even had an account with Barclaycard. I sent in a copy of my final statement clearing my balance dated 2003. They then said i didn't have PPI on my account. I sent a SAR to Barclaycard and a separate CCA request with the relevant fees, but was again told they had no data to send. After lengthy conversations and correspondence, I finally managed to get a copy of my CCA which proved very useful because it showed an 'opt out' box for PPI which was unticked. This was proof that PPI was charged to my account, but I don't have any statements showing how much I paid. I continued liaising with Barclaycard and they sent to me some irrelevant papers, together with their final response rejecting my claim. I therefore referred my complaint to the ombudsman early last year. Barclaycard made me a goodwill offer of £500, which I have rejected.

Unfortunately my complaint is still awaiting adjudication, but I have been asked to try to find further statements at least showing how much PPI I paid, which I do not have. I have a statement back in 2000, but it's only the summary page which shows my credit limit, balance and minimum payment required. My question is, how can I calculate what PPI premiums I paid from 1990 to 2003. My credit limit increased rapidly from 1990 to 2003 up to £15,000 and I always sat at my limit only paying minimum payments throughout this time. However, I don't have the statements to support (very convenient for Barclaycard to say they don't have them). I can prove that I had a balance outstanding of £8,600 in 2000 and that I also paid the card off with £6,500 in 2003.

Has anybody else been in this position? I'm assuming that the PPI payment details would've been on the second page of the 2000 statement. Any advice would be much appreciated.

    Thanks

    Re: Barclaycard PPI claim

    Hi Paulapaula
I am in a very similar situation with Barclaycard which is now in the hands of the Financial Ombudsman. I had PPI put on my B/Card in 1988 without my consent. B/Card upheld my complaint but would not refund me PPI back to 1988 as I had no statements. The only advice I can give you is that you thoroughly examine the paperwork received in your SAR. It looks like computer gibberish but I found two items that I believe prove I had a significant balance from 1988 onwards.
On one printout was a line that declared my average balance based on 12 months of statements and the year that this pertained to. I also found another line which stated what my credit limit was for that date and that it was to be increased (usually a credit limit increase occurs because you are near your credit limit in my experience anyway). I have sent this to FOS as evidence that the card was in regular use with a significant balance.

The other thing you can do is contact Barclays Insurance Dublin who are the underwriters for Barclaycards PPI. Their phone number is 0500 500700. You will need the postcodes for any addresses you have lived at since having the card. they can tell you when the PPI began and the policy number.

One final thing you can send to the FOS is examples of their own rulings where they have upheld claims where statements are not available. These are on their website albeit with a clumsy search engine but there are several examples where alternative evidence has been provided to demonstrate use of the card and statement balances and they have instructed the bank to accept this alternative evidence and recalculate redress back to the start of PPI being applied.

    Hope this helps.

      Re: Barclaycard PPI claim

      Hi Womack67,

Thank you for your response. Unfortunately the SAR papers I received were limited and only reflect the year 2007 (bearing in mind I ceased to use the card in 2003). These printouts only show '0' balances and nothing else. It also shows my credit limit as '0' and, as for PPI, there is an 'N' in the box for no. However, after a long fight and only by referring the matter to the ombudsman, has Barclaycard now admitted that I did have a PPI policy, but they say they have no record of what was charged.

I would like to try to calculate what premiums I may have been charged from 1990, although I don't really have much to go on. I assume that my credit limit was £1,000 back in 1990 and I know that this increased quite rapidly. I have proof that I was up to my credit limit of £8,550 in the year 2000 and I know my credit limit had increased to £15,000 when I ceased to use the card in 2003 (no proof of the £15,000 credit limit). I have proof that I cleared my card in 2003 with a cheque for £6,500. Does anybody know how I can reasonably calculate this?

Good luck with your complaint Womack67, please let me know how you get on.

      Thanks.
