Hello, my mum took out a Barclaycard in 2001. In 2008 i noticed she was paying PPI, so she cancelled it as it was not something she thought she needed at the time and she was unaware that she had this and that it was optional.
In 2012 I decided to help make a claim towards Barclaycard on the grounds that she was possibly mis-sold the PPI. They replied to say the do not believe my mum was mis sold, no reasons as to why they thought this.
We then took my mum's case to FOS who stated that they feel Barclaycard should uphold my mum's complaint. They requested my mum's employment details, sick pay etc, which we provided. They also requested a case file from Barclaycard.
Almost 2 years later Barclaycard have finally provided the FOS with my mum's case file and within this file is an application form for her card taken out in branch. The FOS have now came to a decision and stated because the PPI box is ticked, this is sufficient to say my mum agreed to PPI at the time of application.
However having looked at this application form, my mum's employment details also states that she was on an annual income of under Ł3500. My mum can not remember exactly how many hours she was working at the time but she was definitely working between 10-14 hours per week, and several years later increased her hours to a full time post.
Do you think I should point this out to the FOS? Am I right in thinking PPI does not cover part time employment? Surely at the time of application the advisor would have asked these questions and if this is an exemption then my mum would never have been able to claim.
