  • AA BOS PPI & LOANS APR HIKING & PRocess challenge Help

    Hi this is my first post and its about 3 consequtive loans I took with AA Centrica then Band Of Scoltand from 2003 up until 2011 when I became severely disabled and fell into debt by loosing a high flying job and salary. I need to ask members for advice of how to lodge a PPI claim on this and what rights if any I may have on the last loan in the three when the APR rate was nearly doubled. In those days the loans by AA who then became bank of Scotland but who had the same address from day one were done over the phone then followed up by a courier who brought your cheque but first you had to sign there and then and they would take away the papers leaving you with one at least one occasion only partial information on what you had signed up to. When I feel ill due to a tumour in my head I was fired for being of sick for the first time one week after sickness then had years of dealing with its removal. During this time the local citizens advice wrote to BOS /AA and asked if I had any PPI on what was by then my last loan from them after falling into debt with them and other credit card providers 4 in all. I understood they responded that there was none but am not sure as it closed down in Hull. Earlier this year in a battle to reduce my debts as I am on disability allowance and still have serious illness I wrote a SARS request to each credit card to see if I could see any PPI on them. I asked for an extended SARS so this gave records that were helpful but it appears incomplete. My first question is does anyone know from insiders in the banking system if this is a tactic to reduce claims? do they intentionally only partially meet the sars so as not to give way to more PPI claims. I ask this because I then subsequently found one paper left behind by a courier which showed on it that I was paying 424 a month of which is appears £45 was Credit protection. This was not on the SARS document. I believe it was left behind because on one occasion I asked the courier for copies and refused to sign until he left me something. I don't understand why this did not come n the Sars and what to do about it as the second loan was then superseded with a third loan in 2010 as I had no knowledge that PPI was included or added until last month when I went through the papers in detail. At this point I then discovered that the final loan which had repaid the second loan with PPI added was charged to me at 9.6 apr. I was not told of this and would never have agreed to this knowingly as it double the cost of loans practically and at the time I would have shopped about and got a better rate as I had at that point what appeared perfect health income and credit history and had already paid back two loans. I have one small PPI case for a previous car loan misold as they first claimed it was out of date before I pointed out that the rule is 3 years from when you reasonably knew not three years full stop at least I think. I understand that nowadays distance selling laws are much fairer but I am in a situation where I am using my disability to pay back a debt that first of all included PPI that was unsuitable as it was added without my knowledge or consent and at that time my husband had a significant income and it debt was lower due to the APR rate. I need to lodge a PPI as I also don't know if loan 1 and 3 also had PPI and similar papers that was taken away. I wonder if there is a way to challenge this because it was done on the phone and I can see that the rate was switched without my knowledge . BOS are being fine about my debt repayments but I have worked it out and they can never be repaid in my lifetime and now that I know partially the reason for their fairness is my disability, the fact that they made more than 27K in repayments and profit before this happened and further they are sitting there knowning that my current debt is partially misold PPI at least on one if not more, that in addition they doubled the interest impounding things further. I believe it was unfair to sell like this over the phone as I am also extremely dyslexic and have been tested for a very slow processing speed of understanding what I hear or read and when on the phone in those days they jumped from one permutation to another . It did not help that papers were not sent in advance so that you could see and understand but instead you were made to sign or get no cheque. I certainly would never fall for this kind of thing now . Does anyone know any rules with distance selling and financial regulations that might apply to challenge the debt of the APR and how to ensure that PPI at least and impounded interest comes of this debt as I don't want to leave it for my partner when I die. Any help most appreciated.

    Hi and welcome

    So sorry to hear of your issues.

    Nothing surprises me with some of these banks in regards of our information, as I have more or less experienced something similar.
    However, you are in your right to make a complaint to them and the Information Commissioners Office (ICO) if you google these in google search you will find some useful information, and what you can do if any financial industries etc fail to comply to the data protection act (DPA).

    The fact that you never knew you had PPI, as you obviously never made a claim on them, when for eg when you became unemployed, then you have good grounds to raise a complaint.
    You would therefore raise this up to the business who set up and sold you the account.

    If you check the website of the bank/business they should have a part of how to complain, they should also have a ppi reclaim questionnaire, any problems with this let us know, we will do our best to help. Same rules should apply for distance selling. :tinysmile_twink_t2:
