    Hi there, hope you can help,

    A bit complicated I had an unsecured loan with Norther Rock (originally 2003), back in 2008/9 I got into financial difficulties adn was unable to pay it. There was a CCJ raised and it has now been transferred to Marlin, who are pursuing the debt. As I am starting to get myself straight again I would like to get in a postion to settle the debt. However I am aware there is PPI that should be claimed back, which wilI vastly reduce the value of the debt. I am unsure how to go about this though as the debt is now owned by someone else. I also have no paperwork, so should I start with an SAR and if so to who or should it be both.

    Any help much appreciated

    You need to complain to whoever sold you the PPI. SAR them and also the lender.

      Thanks for getting back to me EXC, So just to confirm the debt was originally with Northern Rock and they made us take the PPI, so I need to SAR them? Then if/when they pay out do I then make that payment to the company that bought the debt ?

      Or do I need to contact the people who now own the debt (Marlin) advise them I dispute the amount and the CCJ as it has now came to light that PPI was part of the Judgement in which case the debt needs to be returned to the original party (Ie Northern Rock)

          Yes there is a CCJ on this debt, from a number of years back. At that time we were in head in the sand mode and also were unaware of PPI and everything that goes with it.

            Correct.

            If you're successful in the PPI claim Northern Rock should pay you directly.

            So you had a CCJ for the debt? Can you tell us about it?

              HI EXC sorry for the delay getting back to you, had problems with me WIFI.

              For the CCJ can't tell you a great deal, it would of been maybe 3-4 years ago, and by Northern Rock. At the time I head my head in the sand and didn't deal with it so can't remember a great deal about it. And as so much time went by I can't find any paperwork now.

              I will SAR Northern Rock, the bit that I am still confused about is what to do with Marlin ? They are pursuing the debt, but what do I do in the interim ? Is the debt with them still valid if I am now disputing due to PPI from Northern Rock, who sold them the debt ?. Also with Northen Rock will they pay the PPI to me ? I am not actually after it back I just want it and the the interest deducted from what I owe so I can deal with the rest and get myself clear, but not sure how that is going to work

                I don't think that there's much you can do with the CCJ now.

                Just so I'm clear, who was the claimant on the CCJ? Northern Rock or Marlin or someone else?
