    Hi,

    first time on this forum so really hoping someone can help me in my situation.

    I have several PPI mis selling claims outstanding and am waiting for responses to come back from the various banks etc.

    The one I need help with is originally from HFC bank that dates back to 2000. I found the original agreement form that clearly shows I had the PPI along with the standard FOS complaint form. HFC bank queries are being handled by HSBC so I sent all the information and copies of the document off to them.

    I received an initial response back from HSBC this week acknowledging my complaint but there was a bit at the bottom that read as follows :

    "In order to assist in investigating your complaint further we require the following :-

    SPI - Evidence of final payment date and amount paid "

    Now as the loan is old I do not have any of this information anymore. I think that this loan was paid off when I took out another loan however I have no way of proving that so what they are asking for, I don't have. Will this cause problems in reclaiming the PPI?

    i have thought about this however and although HSBC are asking for the information about this, if the loan was still outstanding they would have the details on their system. As they do not have this then it's obvious that it has been paid off - or are they asking for the information to base what the additional 8% interest would work out to? Can I waive the 8% interest for the sake of getting a full PPI refund ( it is several thousand pounds ).

    Any help on this situation is most welcome as I don't want to do the wrong thing and risk not getting anything at all or am I in a position where, due to not having the information needed it is doubtful I will get anything back?

    First of all wishing you the best of luck on your reclaims, we are here to help all we can. :tinysmile_twink_t2:

    Right, well basically as long as you have the account number and your reasons, that should be fine, and of course you have the agreement. Did you send them a "Copy of the agreement" alongside your complaint? If not then forward a copy as this will prove at first instance that you were charged PPI.

    Then call into a local HSBC branch and if you an account number of the loan, ask if they will be kind enough to dig up the information of the settlement amount and figures, and/or to provide any details they are able to.
    However, they may suggest you request a Subject Access Request (SAR) letter to their Data dept where they have 40 calendar days to comply, and you enclose the one off payment of £10 cheque or postal order.
    Did you also bank with HSBC? if so then by just giving your bank account number in branch they should hopefully find info on the loan.

    If you want to SAR and require the template letter, let us know in order to post this up for you.

    Another thing as well, I note you said in year 2000 you taken out the loan, but have you any idea on what year you settled it?
    If settled within the last 6 years then its highly likely they will still hold the info of the settlement.

    Complaints dept are separate to that of their data dept from what I am aware of, but if you have any old bank statements where you paid for the loan by direct debit, no matter if your bank was not with HSBC, maybe you still banked with another bank but your loan repayments were made from your bank account, its possible you may see a settlement amount debited from your account which may help:tinysmile_twink_t2:.

    You can make a reclaim on open or closed accounts and you should by rights if successful receive every ppi premium you paid until settlement, plus the relevant interest.

      Many many thanks for the reply. Very much appreciated.

      I sent a copy of the agreement off with my complaint form so they have the account number and the part where it clearly states the PPI amount.

      On the letter sent back to me, HSBC stated that they could find no record of the loan ( probably as it was over six years old and with a different bank ). If I went into a branch and asked for the information you said above would they be able to find it ?

      i don't bank with HSBC so will be unable to ask them to find it through an account.

      Also, so, I really believe that I paid off this loan by taking out another loan to consolidate all my debts so won't have a settlement figure anywhere. Plus I've searched extensively to find a letter from HFC confirming that the loan has been paid off but cannot find it.

      Do you still think I will be successful in this claim ?
      how will they calculate the interest if I don't have a settlement date?

        Hi there

        If you do have a local HSBC branch, there is no harm in calling in by taking in the loan account number, its been known that some are more lenient that others, so maybe worth a shot.

        Now as the loan was consolidated to another loan, I take it that was another business? If so that business where you taken out the new loan should hold these records of what your previous settlement was of the old loan.

        They can still investigate a complaint with the information they will hold or with whatever you provide them with, by also taking into account your reasons.
        However, with some banks if they not able to find ALL the info, they may come up with an offer, if they can see you were paying PPI then they must come to some sort of reasonable amount of offer.

        In regards of the calculations, your are correct to say about the interest calculated to settlement date, but as said above, they may come up with a reasonable offer with interest applied if there is no settlement date to go by.
