  • PPI on secured loan

Ten years ago, wife & I took out a loan to clear off some debts. The bank insisted the loan be tied to our mortgage (secured) but when we went into the office to discuss it with them, they stated that they could not offer the loan unless we took out PPI. Being naiive, we agreed.

Our relationship with this bank eventually deteriorated and I made several successful claims against them. I also made a claim on the PPI on the following grounds:-

    • The amalgamation of the PLRI into the loan itself.
    • The PLRI not being optional, but rather a condition to the loan.
    • The mandatory inclusion of PLRI to be seen as a further cost, or charge.
    • The inclusion of the admin fee into the loan itself.
    • Lack of figure detailing total amount of credit.
    • Lack of figure detailing total charge for credit.

Long story short, they bounced it, including lying about the existence of an in-house letter pertinent to the case. Sadly, the FO somehow found in their favour and that was that. Now, several years later, that bank's behaviour still rankles me. They were the biggest bunch of liars and rogues I ever came across. It's a shame to say that about your fellow man but it's true. And I never forgave them for the way they treated my wife & I. So, the question with me this morning is: can I reactivate/start again a claim that the FO ruled on in the past? It really isn't about the money any more; it's getting satisfaction from seeing in print the admission that they did the wrong thing by us!

Thoughts?? Incidentally, the loan was paid off early back in 2012.

Hhmmm..... just gone through some old, old files and it seems FO's decision is final in such cases. So be it.

How long ago was it that you had the final response from the FOS?

If you think the FOS also failed you unfairly, check out the link below, see if there is anything in there that may help you decide....

Cheers for the link, Di. I think I'll let this slide. I subsequently had a terrible time with that lender regarding a home insurance claim and the slothful FO mediation process dragged on for over a year and I'm not sure I want to go through all that again. It's enough for me to know that I did manage to wreak revenge on that lender on several other issues, though.
