    Hello, new user here on behalf of my parents. Bear with me as it is quite a long winded tale....

    Basically my parents took out an Egg Credit Card in my mothers name a good few years back now, with PPI which they paid each month

    This was moved over to Barclaycard when they took over Egg, and they have around £2,000 on the card at the moment, and make monthly payments and have never missed any.

    Not long after it was moved to Barclaycard, my mother became critically ill and was in hospital for a good few months. Thankfully she pulled through, but the nature of the illness meant that she lost a lot of her memory, and is now registered disabled and un-able to work again.

    Needing to get all their finances sorted out because of this, my father contacted Barclaycard to try and find out what the balance was on the card. However he was denied access on numerous occasions as the account was not in his name. Eventually after providing medical records, Barclaycard accepted and the account was switched into his name. It was then he realised that they had been paying PPI, and it was around that time that media were publicising that PPI is not needed, so my father cancelled it.

    He then tried to re-claim the PPI as being mis-sold, and asked Barclaycard for a copy of the original credit agreement, but they sent a letter back saying that they did not have it.

    Since then, whilst trying to organise his new way of life and caring for my mother, it has sort of been put on the back-burner and he has been making his monthly payments. However he wants to re-visit it now, and says that if he cannot re-claim the PPI, they surely he is legible to claim on the PPI that they paid for my mothers illness?

    I'm not very clued up on my parents rights, so what is the best course of action?

    Do I try and re-claim for mis-sold PPI or

    Do I try and claim on the original PPI that my parents paid for, and can I actually do this, bearing in mind that the policy was cancelled just after my mother became ill, and also that Barclaycard cannot provide me with an original credit agreement?

    In which was the EGG card applied for and was the PPI taken out at the same time?

      It was applied for online and yes PPI was taken out at the same time

          Barclays, bought some of EGG Card in 2011:

          it was previously owned by CitiiGroup and prior to that;
          the Prudential Assurance Company.

          It is somewhat unlikely that Barclays would not hold a copy of one the credit agreements that they purchased for Citi!?
          Sounds like, you need to make a FULL Subject Access Request to Barclays.

              If your after a credit agreement surely you would be asking for it from Canada Square in Worthing which is the rump of Egg bank?.

              But again could be tricky as there are some shedders busy there.

                No, it was Barclays who bought the good accounts;
                the LEMONS remained with Citi/Canada Square Operations...

                  FULL Subject Access Request

                  Dear Sir or Madam,

                  Please supply me with all data that is held on me as an individual: ..................., in relation to Account Number: ............................
                  This subject access request includes in particular, but is not limited to the following:-

                  1. The original signed executed credit agreement and any terms and conditions that applied to the account(s) at the time of default and at the time the account was opened, varied or, otherwise. Where there has been any event in the account history over this period which has required manual intervention by any person, I require disclosure of any indication notes which have either caused or resulted in that manual intervention, or evidence of that manual intervention in relation to the account(s) held with EGG Banking and CitiGroup and Barclays plc. These include all log coms, screen notes, internal memos, telephone recordings; all historical data whatsoever that is held by EGG/CitiGroup and Barclays plc.
                  2. True copies of any notice of assignment and default notices or enforcement that was sent to ................, with copies of any proof of postage that is held.
                  3. Documents relating to any insurance added to the account, including the insurance policies/contract s and terms and conditions of same at inception of these policies/contracts and; a complete breakdown of any PPI refund and how the refund/refunds were calculated.
                  4. Details of any collection charges added to the account; specifically, the date they were levied, the amount of the charge, a detailed financial breakdown of how the charges were calculated and what the charges covered.
                  5. Specific details of the fees/charges levied by any other agency in respect of this account and a detailed breakdown of said fees/charges and what each charge relates to and on what date said fees/charges were levied.
                  6. A genuine copy of any notice of fair use of ............ data as is required by the Data Protection Act 1998.
                  7. A list of third party agencies to which you have disclosed ...................... personal data and a summary of the nature of the information that had been disclosed.
                  8. Copies of statements for the entire duration of the credit agreements.
                  9. Termination Notices.

                  Please note that unless otherwise stated by yourselves and if the documents are not provided, it will be confirmed that you are unable to reproduce/provide in any way shape or form any copies of the above requested documents. You are reminded that you have a duty to inform me if you do not have the above documents. This is confirmed by High Court Law – Ezsias v Welsh Ministers – [2007] All ER (D) 65 (Dec)

                  You are reminded that you are obliged to supply all the above documents in line with the Information Commissioners Technical Guidance (Dated August 2007).

                  I enclose the statutory fee of £10.00, plus proof of my identity. You have 40 days in which to comply.
                  I have not previously sent you payment for the production of any documentation and would remind you that £10.00 id the statutory fee payable under the Data Protection Act 1998. Therefore, it is not to be used for any other purpose or, purposes.
