  • Blackhorse Finance GAP Insurance

    Hello everyone, Yet another thread but this time with Blackhorse. I put an complaint with them regarding mis sale of GAP Insurance on a vehicle I purchased through Benfield Ford in 2007 over the phone yesterday and after a few questions, they rejected me over the phone as they say its the Dealership I had to complain to, and they said they spoke with the Dealership and they said they had no recollection of selling me GAP as it was 6 years ago (I remember and I remember the salesman name also ). The dealership in my opinion sell the finance product on behalf of Blackhorse and Blackhorse only release the funds to the Dealership if they are happy with the Customer after doing credit checks etc on them. Blackhorse are passing on the buck to the Dealership, but its a car finance (HP) not a bank loan. Another Finance company accepted mis sale of GAP to me through a dealership even though they was not present in person at point of sale. Why should they be there as it is a Car Finance agreement done through the Dealership. Anyway I said after wasted minutes to them over the phone I will write to the CEO of Blackhorse and if not satisfied eventually the FOS.

      Hello di30, Gosh Blackhorse was so so stroppy over this over the phone. They rang me the next day asking questions again, said what happened etc, oh its the Dealership, oh the Dealership had no recollection of selling me the Gap ( big mistake me thinks and more ammo to tell the CEO and FOS) and Blackhorse said they understand and in the next breath said to me, you can talk like this all day but we are not going to change our minds and you get a letter. So I thinking, why waste the air time telling me this over the phone and just tell me in your final reponse letter. I think they thought I back down over the phone and accept there verbal response. I got a feeling they will back down anyway. I sent an e-mail to the CEO and told them that if I get an unsatisfactory reply from Blackhorse I be going to the FOS, even if it takes a year or so. I did say to Blackhorse who can I write to about my complaint, they just said we are all the same complaints department and nobody else other then them. Me thinks they are only customer service plebs and there must be higher people up the chain than just them.

        Hello, I have an update. I just received a letter from the CEO of Blackhorse ( Lloyds Banking Group ) referring to the e-mail I sent them on the 30th July 2013 from there High Level Complaints Team saying he is handling my complaint on the behalf of the CEO and await his final response. Fingers cross.

          Yay yes fingers crossed.
          Any problems from here I would also raise up about the attitude of the staff and that you are aware that calls are recorded as procedure, with that you are inclined to be asking for a copy of the recent telephone calls, even if it means a SAR.

          See how this goes first though, good luck.

            I did not mention the attitude of the staff but tempted to forward another e-mail to CEO about the attitude of the staff. Buggar why not.

                Hello just rang Blackhorse for an update on the GAP Insurance, they said final decision letter was sent in the post yesterday. Arrrrr, this could be a 50:50 decision and dread opening the post tomorrow, Lol. What do you Guys think?

                    Well well well, just recieved a letter from the normal Blackhorse Customer Complaints Team dated the 5th August 2013 and there final response is a REJECTION. Right listen carefully. I rang Blackhorse but at the High Level Complaints Team who are the CEO Level and they said ignore the letter from the normal level Customer Complaints Team as through them it was just the initial rejection stage. The High Level Complaints Team said they are on the verge of signing off there Final Response Letter for approval which comes from the top and that decision by them are final. So I asked them if it was a rejection or uphold complaint, the Man said he could not tell me as he did not have the details of what the CEO decided. Arrr more waiting. So from my point of view it could go either way.

                      Just received my final response from Blackhorse to day and its a REJECTION. But I already sent a complaint to the FOS yesterday as I felt I was going to be rejected again anyway to say a bit of time. I wont give up until the FOS agrees with Blackhorse.

                          Yes both departments. They are blaming Benfield Ford Motors but I did not pay any money to them apart for the deposit to hold the car. di30 who do you think is to blame for the GAP Insurance and would this mean Financial Institutes like Blackhorse can wash there hands of this. The agreement etc I sent to the FOS does state paid to Blackhorse.

                            Just had my Credit Card Protection Premiums of £206 plus 8% refunded to me as it was mis-sold. Meaning I got the Credit Card on an non- advised basis ( no sales person involved ) application done on line ( wicked ). The reason I gave was when I received renewal documents two weeks ago stating £83.99 due in September 2013 ( renewed every 3 years ) I rang them up and told them and complained why was CCP on my account even though last year ( 2012 ) when I enquired about PPI that maybe was on my account , they said no PPI or any Insurance product was added to the account. They was wrong CCP was added 6 years ago and I told them I would of cancelled it years ago. Also I never received any renewal documents either 3 years ago to remind me back then. So there is hope for lots of people. I never required CCP as my home insurance covered all my Cards anyway.

                              Whoever set up and or completed your application form are usually the ones you pursue, then they forward your details on to a lender, the lender are the ones who take the money each month.
                              So you always go the broker direction first, if this fails maybe due to non-regulation of the FSA when it was sold to you, then the FOS would then suggest the underwriter/insurer avenue.
