    Hi , I'm new to this forum and wondered if someone can please help.

    Last year I had Lifestyle Claims deal with my PPI and took and advance of about £300 odd which they said would be refundable. I've only managed to get £150 odd back from my HSBC PPI of which 30% Lifestyle said they would take. They sent me a letter where I agreed the refund from HSBC and that I pay them £50 odd on receipt of this. But I did not make any payment to them as I hadnt received the funds until a month or so later. In addiiton to this I totally forgot about the £50 odd payment and there were no reminder letters from Lifestyle Claims chasing this.


    Early this week I have now received a recorded delivered letter from Redhawk Legal stating that Lifestyle have gone into administration and that they are not collecting everything. They have said that i need to pay they £50 odd which is still outstanding plus that if I dont then they will make arrangements for my credit history to be effected which can last 6 years on my records. So to avoid this I need to make payment asap.

    I havent contacted them nor received any chase letter or nothing from Lifestyle regarding this matter and am not sure what to do. Now that Lifestyle Claims have gone into administration does this mean that payment is no longer needed?

    Can someone help as Im not sure what to do plus can i get my £300 odd back which was taken on credit card now that they have gone into administration? i can't believe fell for this scam!

    Hi there & welcome.

    Please could you confirm if Lifestyle are a claims company (I assume they are)?

    If this is the case, you could contact Claims Regulation via Ministry of Justice (MOJ) who should be able to confirm about the administration and your rights with this now, as they deals with claim companies.

      Hi

      Do not pay Redhawk anything. Did they include a new contract for you to sign?
      You do not have a contract with them so you do not have to pay.

      You can reclaim your £300 from your bank under a s.75 claim.

      Tuttsi is the lady here who has been dealing with this, she will undoubtedly be along to advise you in detail.

        Hi thank you for your help and replies.

        Yes lifestyle claims is the ppi company that have scammed me and no doubt many others unfortunately. I haven't paid the £50 odd as that is what redhawk are chasing. Basically it was a claim from hsbc and they wanted me to sign and return the payment letter as confirmation of reciving £160 odd of which £50 odd would their cut of it. This payment i forgot about. It wasnt deliberate at all. And redhawk are now chasing this. They haven't sent no terms or nor paperwork for me to complete before but only this one letter and in a nutshell state that I need to make payment ASAP or my credit history will be effected. This I definitely do not want at all.

        I will contact my bank about trying to get back my £300 odd back.

        I have also had no communication from sharma nor anyone stating that red hawk have taken over from lifestyle claims. I still have the letter from red hawk and can forward it to you please advise me an email address. With regards to the other letter from lifestyle about the £50odd I will need to find. However when red hawk sent me the letter they attached it part of it.

          Yes can you send us all the communications you've had from Redhawk and Lifestyle? I'll send you a private message with my e-mail address.

          The position is that unless you signed a letter of authority from Redhawk, they have no contractual right to charge you as they are not a party to any contract with you.

          You should make a complaint about the unjustifiable threat to your credit rating to the MOJ compliance officer responsible for Redhawk at consumer@claimsregulation.gov.uk

            Definately DO NOT pay Redhawk - they have no authority from you to collect ANY MONEY. They cannot affect your credit history.

            I see Exc has responded...he is sending you his email address for you to send copies of the letters to.

            Please let me know how you get on with the S75 in obtaining your refund £300.

            Please keep us advised if any further letters arrive from Redhawk..... they are treading on dangerous grounds with the MOJ.

              I'm very concerned that they are threatening damage to your credit file. This is inexcusable.

                Thank you I will send you the copies soon. Plus have contacted my bank. They will inform the disputes team and send me the relevant paperwork for a refund. I won't pay any attention to red hawk even though they state that it's a final notice and that they intend to issue county court proceedings against me. Also I've just remembered that when they are asking for the money they are saying that if I have a visa card then to contact a number they've stated or send a cheque payable to red hawk legal ltd.

                thanks I have some peace of mind that my credit history won't be affected.

                  Sorry one other point is that in the letter they say that no payment could also result in calling the bailiffs to the premises to remove goods or for payments to be deducted from my wages by my employer

                    Happa, please make sure that the letter you have just told us about is sent to EXC as soon as possible. They cannot send in the bailiffs, you have not signed their T&C.... they are digging a bigger hole for themselves. Mark my word they will get suspended from the MOJ. They cannot send in the bailiff there is NO DEBT due to them as they have not got your instructions.

                            Happa received a 'letter of claim' from Temple & Co solicitors acting for Redhawk threatening legal action ''in 7 days'' if full payment wasn't made to which we responded on Happa's behalf setting out the grounds on which we intended to defend should they be foolish enough to issue proceedings.

                            This was back in August and we've heard nothing from them since and neither do we expect to.
