Barclaycard rejection of PPI Reclaim

I recently made a claim for mis sold ppi with Barclaycard from 1997, i had on 3 occassions requested T&Cs although i had a acknowledgement i never received them so i just put in the claim.

The claim was because at the time the PPI was taken out i was 18 and claiming out of work benefits - they have responsed saying the policy did not cover "Involuntary unemployment" so rejected the claim.

If they cant provide me with T&Cs how can they know that the policy did not cover unemployment? Anybody got any knowledge of PPI with Barclaycard from 1997?

Should i send a SARs request?

If you were on benefits when you took out the PPI then you were definitely miss sold the policy. Sounds like they have 'misunderstood' the complaint.

You can do a SAR but they will probably only send you the last 6 yrs of data.

You can complain to the FOS once you have a final letter rejecting your complaint from Barclaycard, so I'd write back to Barclaycard challenging their decision and threaten to use the FOS,

I have obtained my NIC record for that year and it proves i was on out of work benefits at the time. Should i send this to them?

Can i do anything about them not providing me with T&Cs? the ICO for example?

Yes do send them proof you were in receipt of benefits.

It won't help their case that they have been unable to send t&c's but the Data Protection Act is often misunderstood and companies only send out 6 yrs worth rather than 'all' info they have on you; which they should.
