    I was stupidly caughtat work and agreed to lifestyle claims also not realising they wouldtake the money straight away. I got home looked them up on the weband realised I had made a big mistake tried to phone credit cardcompany to cancel and was unable to, tried to phone lifestyle claimsand cancel was told to wait for my pack. As soon as I got my pack Iwrote a letter of cancellation and sent the pack back recorded mailwithin the 14 days, waited for ages still had not received money backor any letter. So phoned them was told that I should have received aphone call which I never did and that I would receive my money backwithin 30 days, after the 30 days still had not received anythingback phoned them again to be told that I would receive the money backwithin 30 days from the day I had phoned them. When I asked them whynot from the date of the letter I had sent they said because they hadtried to phone me to verify that I really did want to cancel ? When Itold them that I would be seeking further action they said they werewithin there rights.


    Is this true or shouldI take it further.

    At our recent meeting with the MOJ we had this very discussion about the time it takes to make that refund. We presented them with several other similar situations such as yours and they are looking into those as we talk. They told us that this is covered under distance selling regualtions and that they have this time to repay 30 days from receiving back the pack. I can only suggest that you keep on pestering them on a daily basis.

    You have done everything correctly and if you do not receive the money in the say the next 7 days please let us know and we will contact the MOJ directly for you, we will need some more information from you to be able to do this and you can always PM me with this. I do not think that is fair that you have now to wait a further 30 days and they are out of order on this. If you read the stickies that I have posted up debt and claims management companies you will see some directives from the MOJ and they are definately breaking the rules of there authorisation. http://www.legalbeagles.info/forums/...NT-COMPANIESis.

    ps...Just looked this up distance selling regs they must refund within 30 days http://www.out-law.com/page-430#Refunds I would contact them on Monday and advise them that you will report them to the Trading Standards if the money is not put back into your account immediately as they are in breach of the OFT guideline.

        Thank you I appreciate that and do chase them tomorrow. Try and keep everything by email if at all possible as they will state later if you talk on the phone that they did not say that. But the proof will be in pudding if they have not refunded within the 30 days guideline from receiving back your letter of cancelation and the pack.

        As far as I am aware it is not in their T&C's that it is dependant on a phone call from them to you and since you did not receive such a call and certainly I can find nothing in the MOJ's authisation rules to suggest this. You may want to ask them where it is their T&C's and which rule it comes under with their authorisation with the Ministry of Justice. They cannot change the four corners of the contract or deviate from the distance selling regulations as they will have contravened the OFT guidelinesand it is the Trading Standards that will deal with this aspect.

            Just a quick update :-

            I have e-mailed the complaints department today, and yet again spoke to Hanna whom I had no help from last time at first she was going to terminate the call because as far as she was concerned she had explained the situation. When I informed her that nowhere in the T&C does it mention about the refund being after 30 days of contact from them, her reply was on the lines of - if I made a complaint by the time it was dealt with the money would already have been refund anyway ?.

              Contact your local trading standards immediately and put in a complaint as they are out of order and this is againts the OFT guidelines ans the TS are the ones to help you further with this company. You are within your rights to make a complaint especially after the shoddy way that they have dealt with you on the aspect of your refund when you have followed their proceedure as laid down in their T&C's.

              The more people that complain through the TS the better,

                Sorry I have been away on business, just a quick update.

                I have still not received any money back also I have not had any response back from my e-mail to the complaints department another breach of the T&Cs.

                I have now passed this on to TS who have logged the details and told me to contact my CC which I have done and whom are now looking into under the section 75.

                Have tried to phone lifestyle claims to see what is going on and have been cut off on several occasions, I have just sent another e-mail to complaints and sent it over 20 times. will be interesting to see what happens.

                  Have a read here http://www.legalbeagles.info/forums/...tion-Crm-16588 Lifestyle Claims have been banned from taking upfront fees and are being very closely monitored on complaints by the MOJ.

                  Please lodge the complaint with TS as well as your credit card company under section 75 as they have not provided you with a service and one which you cancelled within the 14 days.

                        Lifestyle Claims are NOW in administration. Please do not get confused as there is also a Lifestyle Money company which are not in administration but is run from the same office in Swansea, but under a different Ltd Company.

                        TC31 is reclaiming his money from his credit card provider under section 75 as they did not provide a service and hope that TC31 is able to recover his money very soon.

                          i am reading some of these reguards lifestyle money.
                          i had a phone call back in january to set up my ppi i paid a upfront fee and they also took another fee from my card. i have emailed them to find out what is happening.
                          Today i have tried to get on to their site and i am unable to get on
                          Have i been had if so can i do anything i'm really p----d off

                            I stupidly signed up to lifestyle to sort my ppi and have not heard anything for months.
                            I have emailed recently todasy as well to see what is happening.
                            How have you got on with them and also have you got a contact number for them?

                              Lifestyle Claims are in administration.

                              Lifestyle Money is a different company operating from the same building, in fact probably the same office.

                              If you have paid money to a company and they have not provided you with a service you should contact your credit card provider and claim under section 75 as they have not provided you with a service.

                              Please be clear which company you paid the money to though as you seem to be a little confused as you start with Lifestyle Claims, yet you talk about Lifestyle Money - they are two different companies.
