  • PPi claims when debt has been transferred, resold

    About week ago I sent off my PPI claim letters to my original creditors. All of my debts have been sold on to other companies as I joined with CCCS after redundancy. I had my first letter back from Citi Bank and they stated that because my debt has been transferred to Opus brand I should contact them for all future correspondence related to this account.
    Is that right? Is Opus brand (CC Asset Management Limited) now responsible for dealing with mis-sold PPI from Citi bank. Should I really contact them instead of Citi and what are my chances of getting anywhere with that?

    Looking forward to some advice as I have no idea what my next move should be.

    Hi and welcome to Legal Beagles.

    In regards of a compaint/reclaim on the PPI, usually it's the ones who set up and sold you the account in the first place.

    I would write back and tell them this as well, just word it like "you understand that whoever sold/set the policy up are the one's you pursue".

    Am wondering if they are trying to pull a fast one.

    Even if the debt has been sold on, and you wrote to them about the reclaim, they may come back and say "its not them", so your back to square one.

    The only other suggestion I have is write to both, cover your ground, one of them is bound to come back and accept taking the case on.

      Hi KK, and welcome. As Di says, it's the Original Creditor who sold you the PPI, so it is they who you pursue for mis-selling it. The payments you made to them before they transferred the debt all included PPI, so it is they who charged you that money, plus account interest on that (I assume). If they then sold the debt on, and you continued paying PPI, then the OC should, I believe, repay you this as well, and seek to retrieve this from Opus.

      It might help if you write back to Citi and tell that if you are forced to refer this to the FOS, then they will not view Citi's conduct favourably, and it will likely cost them over £1000 more (in FOS referral fee and compensation for distress) than they are already liable for.
