    I had a car on finance in 2006 and without knowing i also had ppi, by 2009 i had lost my job and was ge tting divorced and moving back home 280 miles to be nearer family. The loan was with Black Horse at the time and they were fully aware of my change in circumstances, for a few months they let me pay lower monthly amounts until i found a job etc. Three months later i was still struggling and i could no longer meet the payments, Black horse refused to agree to lower my payments, i had paid three and half thousand of my car and the loan was 5995. They threatened to reposess my car, so i contacted them asking them for a settlement figure, because my family had offered to pay it, they again refused to come to an agreement, so they took my car and sold it for £1,700 in a car auction, this was in December 2010, from that day i have not heard anything from Blackhorse and didnt know to very recently how much my car was sold for.

    When a friend advised me to try and claim back ppi i did which has took 5 months and they won my claim. 5 weeks ago i received a letter telling me that i had won back £ 1294. Today i have received a cheque from the garage i bought my car from for £161. They have taken the rest of the money for what they say is still outstanding. Two weeks ago i recieved a statement saying I am in arrears by £3000 thats how i know how much they sold my car for. I have not heard anything from them for 15 months which i find strange. can they do this?

    Hello and welcome to Legal Beagles.

    Yes unfortunately, if there was an outstanding debt, I am aware they are able to do this, even though they taken the car from you, maybe someone else on here can clarify on this one, and they are within the time limits to do so (6 years from when you taken out the finance).

    If they have not sent you a detailed breakdown, you can contact write to them and ask if they will send you one, so you will know how they calculated the breakdown, you are entitled to this on request if they have not sent you one.

    Meanwhile, maybe someone will be along soon to confirm on this.
