    informed that they purchased the accounts in March 2008.
    does this shed a new light on things?
    Not really, just means that you SHOULD OF recieved a default notice for each account then an assignment notice for each account BEFORE march 2008, if it is true that Cabots bought the accounts in march 2008

    You didn't record the phone call by any chance did you????

      Yes i have recorded it all, so have they during the converstion i was informes that four acccount were purchased on december 2007 and that refunds from June 2010 of 3 ppi and unfair charges, plus interest had been refunded to the card with the highest balance, in total £2369.75, i have had no communication regarding this., any way the person i spoke to said she would confirm these refunds individualy in writting within the next 7 days.

          As promised the breakdown of refunds including ppi, late payement fees and interst refund, arrived this morning, payments in total of £2369, refunds applied in aug 2008 and july 2010.
          So am i correct in saying that barclays where not ressponsible for my accounts, when awarded the refunds?

            A letter came this morning from cabot regarding my SAR, which reads
            "Thank you for your letter etc. We are currently compiling a file in relation to your personal data. We intend to provide your information in the form of an encrypted CD. Please be adviced that cabot may not hold information such as your credit agreements or staments on file. n order to obtainthis information, we recommend you contact the original lenders ( then listing Barclaycard as one of the lenders) who will hold this information as the original data controllers. However, in the event that the original lenders have supplied Cabot with this information, the documents will be included with your SAD"

            This is the first time I have requested a SAR, is this correct, any adcvice plese

              Had a reply from Barclays.

              I dont think they have read my letter, I was complaining regarding how my ppi refunds had been forwarded to cabot a dca, without my permission, i have evidence confirming the sale in 2007, I also referring to the fraud act 2006 etc. They have replied with a template letter saying we are sorry you have a complaint regarding the sale of ppi, we will review your complaint by the 14th of november, also enclosing a questioner to fill in how the ppi was sold etc.
              Any ideas or adice please on how i should respond to this letter.

                Hiya

                Sorry for not keeping up on this one, yes this is about standard, they should provide you basically with everything they still hold on the account(s) going back to at least the last 6 years, although they may still hold data going back to even earlier years.


                In regards of them sending you a questionnaire, this is also now standard procedure, especially for Barclays.
                So I would then complete to the best of your knowledge, if you have kept a copy of your letter then use your info from that for the completion of the form.

                Also please be aware that many of the banks are given extra time, normally its 8 weeks, but the FSA have given approx 16 weeks, even though they may still give you a decision before then.
                Don't worry, all will be ok, I know its a pain with having to do this, as you've already sent a letter, but going by others who have been dealing with this bank it must be the procedure for them to use now in completing of the forms.

                    Update on the barclays saga, posted a secound letter advicing barclaycard that my complaint is not about the missold ppi, but about how the funds have been sent to a third party without my consent etc, receied a respnce stating they will hopfully resolved my complaint by the 27th of october

                        That seems a bit naughty, as section 7 (1)(c) of the Data Protection Act 1998 (link) states and requires that the data is to be presented in "an intelligible form".

                        As few - if any - human beings have yet been fitted with the means to read a CD-ROM directly, I would contend that supplying the data on a CD-ROM does not comply with the Act.

                          Yes all the accounts where purchased in 2007 by cabot, i have also received a brake down of ppi refunds and unfair charges refunded from barclaycard to cabot/morgans as requested. The dates the refunds where applied is 2010 onwards.
