Morning all

Has anyone heard anything about the JR this week? It all seems to have gone a bit cold... I guess we're just waiting for the FSAs Acknowledgement of Service to become available (should be made available within the next week?)

Just spoke to the court (again) and we should have it the middle of next week.

The listings department also confirmed that the case will be heard on 25 January and is listed for 4 days. However it is a 'rolled' hearing which combines an application hearing and the actual case, should the application be granted. So it is possible that the court could refuse the application and no Judicial Review takes place.

Lets hope it does not take place then.

Reading up on it, if permission for the application is refused the BBA can appeal to the Court of Appeal.

Although it's not unusual for a JR application to be considered in a hearing (as this one will be) the court most often grants or refuses permission on the strength of the application & acknowledgement of service alone, which may suggest that the BBA's case is not clear cut but somewhere in the balance.

In my view this further devalues the banks' justification for holding complaints ''pending Judicial Review'' when in fact their right to Judicial Review is yet to be established.

Only that there will be some public places at the hearing and Legal Beagles will be there. According to the listings office the hearing will be heard by a single judge, who has yet to be appointed. It is envisaged that the granting or refusal of the application will be given by the end of day 1.

We're still waiting on the FSA's & FOS's acknowledgment of service from the court which we have been promised will be in the post this week (unbelievably the court only has hard copies) and we'll scan & post them up. We're also hoping to have the FSA's response to the BBA's letter before action in the next couple of weeks

A user on another forum has posted that the FSA will be making a statement on the JR on Friday. Can anyone confirm the truth of this?
