  • Marks & Spencer PPI Help needed

    I took out a Chargecard at M & S in 1998 which changed to an M & S Money credit card in 2003.

    I have recently tried to reclaim my PPI as I have a pre existing condition but M & S have rejected my claim & given a final response, they say it was a none advised sale even though the application form said We strongly recommend you take out cover by ticking this box.

    When I rang the Ombudman to start the ball rolling I was advised that my case was not covered by them as I took out my card before M & S became regulated by the FSA.

    Has anyone got any ideas of who to contact now to try to reclaim my PPI? The only idea I have had is to write to the Chief Executive of M & S Money to see if I could win a goodwil refund.

    Any advice would be greatfully accepted.

    I am thinking of sending a letter to the chief executive of M & S Money, has anyone got any ideas of what to put in it?

    FOS are not interested as I took out my card in 1998.

      Natalie, hold fire on a letter to the Chief Executive for 24 hours, I will check which organisation you have to write to about this.

        Hello Natalie and a very warm welcome to Beagles.
        There is quite a bit of info about PPI on here. If you have a read through it, it may help you.
        The reasons for mis selling and the letter templates are also there.

          I have already been succesful in two PPI reclaims, but this one is stumping me, I am hoping that appealing to the better nature of the Chief Executive might help - loyal customer etc.

            It may be worth a try, I personally have never seen anyone else try this method.
            I only know if the FOS have said no, you can still go the court route.

              online PPI resource, what were the relevant regulatory rules and codes?
              The link above goes through the governing bodies and what there rules stated.

                  FLA complaint route is a lot quicker that FOS complaint route. The main difference is that they aint got much clout, they will make a little noise which nobody listens to lol.

                    You are right, FLA rang to say they couldn't help so I contacted the insurer who underwrites M & S PPI - Norwich Union which is what it says to do on the M & S website.

                    They said that they will contact me within 10 days which is up on 8 April

                        Hamilton Insurance is now dealt with by Norwich Union who have stated that they did not deal with M & S when I got my card.

                        Cornhill direct, or Zurich as they are now known refuse to have anything to do with my claim & have directed me back to M & S, I sent an email for the personal attention of the Chief executive complaining about how my complaint was handled, naming the Customer Service representative who dealt with my complaint & surprise surprise, received a reply from the very person I was complaining about stating that any further letters would be acknowledged & then filed without further action.

                        Has anyone got any ideas of how to proceed?

                            I haven't paid any more PPI since I started my complaint last November.

                            I was sold my PPI & card by a sales assistant in store with a clipboard.

                              I would be going after M+S for this mis-sold PPI.


                              1) Avoid phone contact and always keep any correspondence in writing.
                              2) Keep all copies of letters sent/received from the company involved.
                              3) Exhaust the companies complaints procedure.
                              4) Send all letters by R/D or S/D to ensure you have proof of delivery.

                              The FSA rules are very clear about what firms and advisers selling PPI should do at the time the insurance is sold to you. This will differ slightly depending on whether the sale was classed as "advised" or "non-advised". Companies and/or advisers should have made it clear to you on which basis the sale was made.



                              All firms and advisers must do the following, whether or not the sale was ‘advised’ or ‘non-advised’.
                              • The adviser should have made it clear that PPI was optional (if this was the case).
                              • The adviser should have made you aware of any significant policy exclusions and checked whether any of these exclusions applied to you.
                              If some or all of this information was not made clear to you either before or at the time you agreed to take out the insurance, then you have grounds for a complaint.

                              The adviser might have tried to persuade you to take out PPI by saying something like “we strongly recommend that you consider taking out PPI”. If this is the case, then the sale has moved from a ‘non-advised’ to an ‘advised’ sale. If this happened to you and you did not receive a demands and needs statement, then you have grounds for complaint.

                              There are certain additional requirements on firms and advisers that carry out ‘advised’ sales. With an advised sale the adviser must assess whether you need PPI, considering your circumstances and any existing insurance you might have. The adviser must also assess whether the policy, including its costs, meets your needs.

                              If the policy does not meet all your needs, perhaps because of one of the exclusions, the adviser must clearly tell you which of your needs the policy will not meet and must take this into account when considering whether to recommend the policy to you. With advised sales, the adviser must issue a demands and needs statement to show why a particular policy has been recommended and why it is suitable for you. Firms or advisers giving advised sales must keep records showing that a suitable recommendation was made, and recording any demands and needs that might not have been met.

                              The rules are very clear that you must be given a certain amount of information at the time you are buying the insurance so you can make an informed decision as to whether the insurance is right for you or not. If you were not told about things like cost and policy exclusions until after you had bought the insurance then you could not take these things into account when you made your decision.

                              LOL eh. Final LBA to M+S with some of this info included so they know you mean bizz and know your stuff aswell, then Court is your final step.
