I'd hold off until after 20th and see if Bank Smart pay up first.

I've just noticed on the draft letter to Bank Smart I said you wanted payment by 20 April but it should be May. Did you change it?

Yes I did change it also the ombudsmen emailed me today for information should I send what they want or hold on

Ok, I would respond to the Ombudsman and say that you've just received a final response from Bank Smart since sending them the complaint - which was beyond the 8 weeks they had - and that in principle you've agreed to what BS have offered in settlement ie cancelling the invoices and paying £260 in compensation BUT you're concerned that they won't honour it, so ask them their advice on what you should do.

Also send the Ombudsman the letter from Bank Smart and explain it was backdated.
