The Legal Ombudsman has now published details of the scheme which operates in a similar way to the Financial Ombudsman.
The key scheme rules are:
- In order to take your complaint to the Legal Ombudsman you must first have complained to the CMC and given them up to 8 weeks to issue their final response. You can also take your complaint to the Legal Ombudsman if you have not received a final response within 8 weeks. You must submit your complaint to the Legal Ombudsman within 6 months of the end of the 8 week period.
- The Legal Ombudsman will only accept complaints about service issues and not conduct issues which relate to the conditions of a firm's authorisation.
- The Legal Ombudsman will make its decisions and recommendations on the basis of whether the service provided was fair and reasonable.
- It has the power to require a CMC to reduce or refund fees and to award compensation where the complainant has lost out or has been badly treated.
- Once accepted by the complainant, the decisions of the Legal Ombudsman are binding and are enforceable through the courts.
- The Legal Ombudsman aims to resolve complaints within 3 months.
- The scheme is free for consumers.
