    Good-morning received from bank smart today upholding my complaint, , they say “ goodwill gesture” they will uphold even though they don't agree bla bla bla,
    i will be making the ombudsman aware of this companies ill practices, for the other unfortunate clients who are in the same predicament, ( don't think theres a shortage of them going by this forum alone)
    all i can now say is a very big thank you to you all, your professionalism, , understanding, and writing of letters in way of making things very precise and clear has been outstanding, this company and companies like this, do there business in a very threatening, and only step back once they know someone with a legal knowledge of practise law steps in, so thanks , you have taken a very heavy weight off my shoulders

      No problem, I'm really pleased for you. The reality is they never really had a leg to stand on and are just speculatively invoicing ex-clients who had previously paid either cancellation fees or 'breach of contract' costs, in the hope they might pay some more.

      Rather than contacting the Ombudsman, it would be more effective to contact the Financial Conduct Authority who are supposed to be regulating them.

        Great news - not sure they can 'uphold your complaint' and then call it a 'gesture of goodwill' but whatever makes them feel better !

        Glad this is sorted for you - please make a complaint to the FCA - they don't help in individual cases but they are still investigating bank smart so as much info about their behaviour as people can give them has to help. They think 'settling' before the ombudsman is involved will stop the FCA knowing what stunts they are pulling.
